Court overturns verdict in case against ex-customs chief

The Supreme Court of Cassation has quashed the Appellate Court’s decision to sentence ex-Federal Customs Administration Head Mihalj Kertes to six years in jail.

BELGRADE The Supreme Court of Cassation has quashed the Appellate Court’s decision to sentence ex-Federal Customs Administration Head Mihalj Kertes to six years in jail. Kertes was found guilty of transferring multi-million sums to Cyprus in the 1990's, robbing the state budget. Court overturns verdict in case against ex-customs chief His lawyer Predrag Milovancevic told Beta news agency that the Supreme Court of Cassation had returned the case to the Appellate Court. “A request for protection of legality that Kertes’ defense submitted to the Supreme Court of Cassation has been accepted and the court determined that the law was violated,” he pointed out. The Appellate Court will in the retrial decide on the appeal to the original verdict of the Special Court that sentenced Kertes to eight years in prison. Kertes was convicted of abuse of office from mid-1994 until October 5, 2000. He gave part of the Federal Customs Administration’s money to 1,182 companies without legal grounds on orders of then Yugoslav President Slobodan Milosevic and former Deputy PM Jovan Zebic. He was also found guilty of transferring at least DEM 38mn to Cyprus without the approval of the National Bank of Serbia (NBS). His lawyer Predrag Milovančević told Beta news agency that the Supreme Court of Cassation had returned the case to the Appellate Court.

“A request for protection of legality that Kertes’ defense submitted to the Supreme Court of Cassation has been accepted and the court determined that the law was violated,” he pointed out.
