Investigation into Dick Marty’s allegations could be taken over by the International Criminal Court or by a special independent court, says Carla Del Ponte. “If EULEX cannot take over the investigation into organ trafficking allegations in which Kosovo politicians are involved, there are two more options,” she told weekly NIN. Del Ponte: Two options for investigation The former Hague Tribunal chief prosecutor pointed out that the International Criminal Court (ICC) in The Hague or an independent court modeled after the Special Tribunal for Lebanon could take over the investigation. “You simply cannot read the report and look away. An international institution which is capable of conducting a detailed investigation must investigate the report,” the Swiss ambassador to Argentina stressed. She stated that due to complexity of the case it was not very plausible that any international court would be able to investigate the accusations which included several Balkan countries and in which Kosovo PM Hashim Thaci was involved. “I know from personal experience that no state body can see such investigation through,” Del Ponte said. The former Hague Tribunal chief prosecutor added that the tribunal’s personnel had been very seriously threatened by the Albanian mafia and former KLA operatives when they attempted to conduct the investigation into organ trafficking accusations in 2004. She stressed that their investigation had been prevented and denied accusations that the Hague Tribunal had concluded that the accusations were unfounded because there had never been a thorough investigation. Del Ponte questioned EULEX’s resources and political support needed for the investigation. “I’m afraid that EULEX won’t be capable of conducting this investigation, because you can imagine what kind of problems its personnel will be facing in Kosovo,” she was quoted as saying.
