The International Court of Justice denies that it has already formed its opinion on the legality of Kosovo’s independence, daily Politika reported. ICJ President Hisashi Owada said that the court is not able to predict what kind of stance the judges will take and what conclusion they will reach related to Kosovo’s independence proclamation. The letter explains that the 15 judges of the ICJ come from different places and that even though there can be different points of view on the situation, the final adopted stance will represent the court’s opinion as a whole. The court stated that Owada said that the court will approach the arguments presented to the court very carefully. The court asks that Owada be enabled to do his job “in the service of international peace with complete objectivity and freedom of decision,” adding that the comments and misinterpretations of his statements “seriously endanger the peace needed for the court to work.” Russian news agency released a story on November 19 that Owada claimed that the ICJ’s opinion on the legality of Kosovo’s unilaterally proclaimed independence would be neutral. International law expert Tibor Varadi, who represented Serbia before the ICJ in a case filed by Bosnia, said that Owada’s statement was “strange and unacceptable.” Kosovo proclaimed independence from Serbia in February 2008. The UN General Assembly decided, after an initiative from Belgrade, to ask the ICJ for its opinion on the legality of Kosovo’s proclaimed independence. An open debate on the issue will begin before the ICJ on December 1 and is expected to last until December 11.
