Former Kosovo Liberation Army (KLA) member Shefqet Kabashi has pleaded guilty to contempt of court charges at the Hague Tribunal. Kabashi was charged with contempt of court after he refused to testify at Ramush Haradinaj’s first trial. Former KLA pleads guilty to contempt of court He pleaded guilty to two counts of contempt of court for deliberately refusing to answer prosecutors’ questions. As a prosecution’s witness Kabashi refused to testify at Haradinaj’s trial in June and November 2007, even though he appeared before the judges. Judge Alphons Orie has announced that the court could deliver a verdict on Friday afternoon. According to the Hague Tribunal rules, Kabashi can be fined with EUR 100,000, get up to seven years in prison or both. Haradinaj’s retrial started on August 18 in the Hague Tribunal. Kabashi once again refused to answer the prosecutor and defense counsel’s questions “not because he does not want to but because he is unable to”. Kabashi is considered to be a key witness in the retrial of Haradinaj, Idriz Balaj and Lah Brahimaj bearing in mind that he was a guard in a KLA prison camp in the village of Jablanica near Decani. Haradinaj, Balaj and Brahimaj are accused of murder, torture and cruel treatment of Roma, Serbs and Albanians in the Jablanica camp in the summer 1998. The Hague Tribunal acquitted Haradinaj after the initial trial in April 2008. The Appeals Chamber ordered a partial retrial in July 2010 because Kabashi and another witness did not testify. It is believed that Kabashi had been in the U.S. since he refused to testify in Haradinaj’s trial in 2007. Despite the court order to stay in The Hague, he escaped from his hotel and went to the U.S. The Hague Tribunal therefore charged him with contempt of court and issued a warrant for his arrest. He pleaded guilty to two counts of contempt of court for deliberately refusing to answer prosecutors’ questions.
