One of Serbia's largest companies is accused of abusing its position in the market to form a monopoly.

Delta to face monopoly fines?

The chain of stores located nation-wide was bought before the Serbian parliament set up the commission, which was used by the company, and its owner, tycoon Miroslav Mišković, as grounds to file a complaint with the Supreme Court, rejecting the commission's jurisdiction in the matter.

According to the commission's president, Dijana Marković-Bajalović, the ruling is not expected any time soon, as the court, which has 17 judges, is currently looking at 18,000 cases.

"The company denies that the acquisition of the retail chain resulted in unlawful concentration, but it is up to them to prove that it did not happen. When a company controls 40 percent of a market, it must prove that its position is not dominant. We have appraised other conditions, too, and we expect the ruling to be in our favor," Marković-Bajalović explained.

However, she added that the Competition Protection Commission, along with the Ministry of Trade and Services, has recently set up a working group to prepare amendments to the current monopoly laws, as they proved to be deficient in practice.
