Hague: Request to order Seselj back to jail rejected

The trial chamber of the Hague Tribunal has rejected a motion filed by the prosecution to order Vojislav Seselj to return to the detention unit.

Hague: Request to order Seselj back to jail rejected

The chamber stated that the prosecution did not appeal against the decision to grant Seselj provisional release, but was now asking for the decision to be reexamined - something that would be possible only based on new fact, "which have not emerged."

The newly appointed judge in the Seselj case, Mandiaye Niang, was opposed to the decision reached by the chamber's majority.

Seselj has been indicted for crimes against humanity and violations of the laws or customs of war, and was temporarily released on humanitarian grounds last November after spending 11 years detained at the Hague. His trial is still ongoing.

The Hague prosecution on December 1 requested from the trial chamber to order him back, stating that Seselj, with his behavior since the release, "undermined the spirit" of the decision to grant him temporary freedom.
