THE HAGUE The Hague Tribunal has granted temporary release to former Serbia's National Security Agency (DB) Deputy Chief Franko Simatovic. Simatovic will have to return to custody on October 4 to attend the closing arguments. Tribunal grants ex-state security official temporary release Simatovic and former National Security Agency Head Jovica Stanisic are being tried for war crimes against the non-Serb population in Croatia and Bosnia-Herzegovina between 1992 and 1995. At the same time, the Hague Tribunal denied the defense’s motion for Simatovic to be temporarily released again after October 4, until the day the verdict is to be announced, which would be three months with an option of extension. The defense explained its motion filed on June 20 by saying that the defendant was no threat to witnesses or victims and there was no risk of his escape. Judge Alphons Orie stated in his decision it was not necessary for the defendant to be in the Hague Tribunal until the closing arguments, planned for October 11. Orie believes the prosecution's submissions in opposition of Simatovic's release failed to prove that it would undermine the Hague Tribunal's credibility and reputation among witnesses and survivors. The trial of Simatovic and Stanisic began in April 2008 but it has been postponed a number of times because of Stanisic's poor health.
