Radovan Karadzic has appealed the decision of the Hague Tribunal to deny his request for dropping charges against him because of an alleged immunity deal. In the document, published by the tribunal on Monday, the former Bosnian Serb political leader asked the appeals chamber to abolish its decision and order the trial chamber to perform a preliminary questioning of witnesses that can confirm the existence of the immunity agreement he had with U.S. diplomat Richard Holbrooke. Karadzic said that Holbrooke had promised that he would not be arrested and extradited to the Hague if he pulled out of politics and public life. He claims that Holbrooke acted on behalf of the UN Security Council, which founded the Hague Tribunal, that the agreement obligates the tribunal, and rules out his responsibility. Holbrooke denied these claims, stating that Karadzic was never promised that he would not be prosecuted by the tribunal. The Hague-based court stated on several occasions that even in case the agreement did exist, it would not be obligated by it. Karadzic was arrested on July 21, 2008 in Belgrade after hiding under a false identity for 12 years. He was extradited on July 30. The charges against him incude war crimes and genocide.

Karadžić based his initial request, made on May 25, on the claims that Holbrooke promised him immunity at a meeting in Belgrade with Serbian and Bosnian officials on July 18-19, 1996. Karadžić said that Holbrooke had promised that he would not be arrested and extradited to the Hague if he pulled out of politics and public life.

He claims that Holbrooke acted on behalf of the UN Security Council, which founded the Hague Tribunal, that the agreement obligates the tribunal, and rules out his responsibility.

Holbrooke denied these claims, stating that Karadžić was never promised that he would not be prosecuted by the tribunal.
