First constitution, then election date

The daily’s source, who claims participation in the consultations with Prime Minister Vojislav Koštunica, states that tomorrow’s parliamentary meeting will be used to adopt the new Constitution, and that the meeting will then be cut short so that an agreement can be reached regarding the elections.

“We are currently closer to having elections in December, but the announcing of elections will have to be done under the old Constitution. That means that there is a chance that a new parliamentary group will be adopting the Constitutional Law,” the source claims.

Former president of the Serbian Constitutional Court Slobodan Vučetić said that the Constitution needs to go hand in hand with the Constitutional Law.

“The Constitutional Law which introduces the new Serbian constitution into life needs to be adopted at the same parliamentary meeting at which the Constitution is confirmed. Everything else would be inexplicable and unconstitutional. There is a constitutional procedure that must be honored before adopting the new Constitution, and it would be logical to respect it in relation to the Constitutional Law as well.” Vučetić said.

“The Constitutional Law must be adopted because it determines the transitional regime and the period of elections, along with the way and dynamics that the new Constitution will be implemented, and the deadlines for the legal system to bring itself into accordance with the new Constitution.” Vučetić said.
