Šešelj’s appeals dismissed

Fausto Pocar dismissed the appeals filed on February 19, and March 2, 2007.

Šešelj claimed that refusing to reimburse the expenses incurred in the preparation of his defense violated the right of the accused to a fair trial.

At the same time, it violated the principle of “equality of arms” between the parties and the right of the accused to self-representation before the Tribunal, guaranteed by the Statute.

Dismissing Šešelj’s appeals, the president noted that they were sent to a wrong address, as the obligation to ensure fair trial lies primarily with the Trial Chamber.

Šešelj was therefore advised to raise those issues before the Trial Chamber hearing his case, consisting of judge Antonetti, judge Robinson and judge Bonomy.
