"Genocide was not committed in Croatia in 1990s"

Neither Croats nor Serbs were the victims of genocide in the territory of Croatia during the war in the 1990s, a well-known Croatian lawyer believes.

"Fortunately, there has been no genocide. The legal situation is indisputable and it stems from the practice of international courts. With the weighing of their options by the two governments and the decision to withdraw the lawsuits, we exit the legal domain and enter the sphere of pure politics - the timing and the moment that will suit the governments of Croatia and Serbia to make such a move and withdraw the lawsuits, without inflicting political damage on themselves," Nobilo was quoted as saying.

He noted that "the Croatian policy" has set a series of conditions, but that "these are not legal conditions, and neither are they directly connected to the lawsuit itself - such as the return of cultural goods or demand for data on the missing persons."

"An elegant political way out is being sought for the lawsuit to be withdrawn, without damaging the authorities in Croatia," he believes.

However, this lawyer is not ruling out the possibility that once the process starts, an out-of-court settlement may be reached.

"The governments should bear in mind that this will be increasingly difficult to do as time goes by, and that the cost of the trial will be increasing," Nobilo warned, and added that "nobody knows for certain" what that figure that may be.

"Both sides have hired international legal experts, whose services cost a lot. There are also court costs that must be paid. The ICJ does not work for free. But the priciest item will be the international law firms representing both sides," Nobilo concluded.
