  3. icj1:

I am sure that they will take all your word play into consideration when the joint criminal enterprise is told to pay damages to Sarajevo.

And who will be paying those damages?

Tudjman from the grave? Or the state of Croatia?

Clearly the State of Croatia will pay because the legal representative of the state of Croatia was Tudjman. And Croatia must bear the burden of its legal representative who made decisions on its behalf.

Not only will the state pay, but it will raise taxes on its citizenry to do so.

As for Milosevic. He died before his trial could be completed and therefore he was not proven guilty of the charges brought against him. According to Western law he is innocent (because all people are innocent until proven guilty -- even Milosevic).

And not only that. In the trial against Seselj, the ICTY concluded that the state of war in Yugoslavia was legal due to illegal secession. The breakup of Yugoslavia was against the constitution of Yugoslavia because it required that all the republics and provinces had to agree if somebody wanted to break away. Only the Yugoslav assembly could agree on changing the borders of Yugoslavia. The JNA defended its borders.
