The High Judiciary Council of Serbia (VSS) said that it sent an explanatory decision to every judge who was not reelected recently. This was not a “circular letter”, as some judges who were not reelected claim, said the council. Council sends explanatory letters to judges The council said that the judges who were not reelected have the right to use all legal means provided by the law in the protection of their rights, but stressed that any other initiatives and activities will be regarded as pressure upon the independence of that body. The High Judiciary Council quoted the ruling of the Constitutional Court of Serbia, on the constitutionality of the procedure of the general election of judges, reached at the initiative of the Judges' Association of Serbia, reads the statement. The statement notes that the decision that VSS sent to the judges does not contain legal notices, since this body holds that the judges who were not elected in the general election procedure do not have the right to appeal the decision on the termination of their offices. “Any judge who believes that by the decision of High Judiciary Council some of human or minority right or freedom, guaranteed by the Constitution of the Republic of Serbia, has been violated, has the right of appeal to the Constitutional Court,” VSS said.
