The Hague Tribunal has rejected a motion filed by Ratko Mladic's defense to reject genocide charges against him, since the indictment does not name the victims. Defense layer Branko Lukic submitted the request in mid-September in his preliminary objection to the form of the indictment raised against his client. Hague: Mladic's defense motion rejected Judge Alphonse Orie, who presided over the trial chamber that made the decision, said that the prosecution's argument that the victims were sufficiently identified as members of an ethnic group was accepted. At the same time, they noted that Mladic was not charged as the direct perpetrator. The chamber ordered the prosecution to submit its list of the victims identified thus far to the defense by November 1, appraising that this would help prepare Mladic's defense. It was announced that the prosecution previously planned to submit the names. The chamber also rejected the defense's objection stating that the indictment does not identify the perpetrators to a sufficient degree. Mladic, the military leader of Serbs in Bosnia during the 1992-05 war, was indicted for genocide committed over some 7,000 Muslims in Srebrenica, and for an unspecified number of victims in eight other municipalities. He was also charged with committing war crimes. Mladic is currently in hospital suffering from pneumonia. The tribunal, which does not publish information about the health of the accused, confirmed that Mladic was "receiving medical treatment". Mladic was extradited to the court in late May.
