The Higher Court in Belgrade acquitted on Wednesday Sreten Popović and Miloš Stojanović who were charged with aiding the murder of the Bytyqi brothers in the village of Petrovo Selo in 1999.
“The U.S. remains deeply concerned that, to date, no individuals have been convicted for the 1999 killings of U.S. citizens Agron, Ylli, and Mehmet Bytyqi. While attempting to save the lives of a Roma family from Kosovo, the Bytyqi brothers were detained without due process by Serbian authorities and suffered an execution-style death,” reads the State Department statement.
The Bytyqi brothers arrived in Kosovo in order to join the ethnic Albanian so-called Kosovo Liberation Army (KLA) during the 1999 war. The were arrested after the war on charges of illegally crossing the border from Albania, and sent to jail in the town of Prokuplje after being found guilty on misdemeanor charges.
According to the indictment, Stojanović arrested the Bytyqi brothers after they had been released from prison in Prokuplje on Popović’s orders.
He then took them to a Serbian police (MUP) training center in Petrovo Selo where he detained them. The following day, on July 9, 1999, they were taken by Serbian police officers who killed them.
The Bytyqi brothers’ remains were found in a mass grave near the MUP Special Anti-Terrorist Unit (SAJ) headquarters in Petrovo Selo in 2001.
Explaining the verdict on Wednesday, the judge stated that the court had only determined that the suspects had taken the Bytyqi brothers from prison, where they served their sentence for a misdemeanor, and then put them in a room without any adequate living conditions.
“This could possibly be torture or inhumane treatment but it is unclear why the prosecutor has not charged them with it. It is also not clear, as it is written in the indictment, what was the trial in which the Bytyqi brothers were deprived of their right to a fair trial,” the judge added.
The War Crimes Prosecution has the right to appeal and the Appellate Court is obligated to make a final decision in the case bearing in mind that it no longer has the right to quash the initial verdict.
"NATO and the U.S. broke international laws with the illegal bombing of Yugoslavia"
Incorrect. No such law(s) on the international level exist about being illegal to employ bombs during wartime....because war involves bombs, full stop.
Furthermore, who legislates this "international law"?
Anyway, if the intentions of these "loved sons" was to kill
(Peggy, 13 May 2012 03:06)
That's why the due process is needed, dear; to prove that "if".
----------
then they certainly were not going to give their victims due process and therefore forfeit the right for one themselves especially if it's known they would be defended by the mighty US and most likely got off as a result.
(Peggy, 13 May 2012 03:06)
Woow, according to this perverted logic of yours, somebody can come and arrest you accusing you of intending to murder a person and execute you without any due process. Thanks God Serbia is not ruled by you - Iran would have looked like a paradise of the rule of law in comparison...
(icj1, 13 May 2012 15:22)
As a parent I can not imagine the pain that the parents went through to have three sons buried at the prime of their lives.
(Jeff. D, 12 May 2012 16:35)
===…==
Same pain felt by Serbian parents, especially the ones who suspect that their loved sons and daughters were harvested for organs.
How would you deal with those monsters? Do you think they deserve due process?
Anyway, if the intentions of these "loved sons" was to kill then they certainly were not going to give their victims due process and therefore forfeit the right for one themselves especially if it's known they would be defended by the mighty US and most likely got off as a result.
(Peggy, 13 May 2012 03:06)
We all know what those men went there to do.
(Peggy, 12 May 2012 18:07)
How do you know, dear, without a due process ?! That's one of the purposes of the due process (which you deem unnecessary); to correctly establish the facts...
(icj1, 13 May 2012 01:17)
Try entering any country with that intention and see if they will give you due process or just shoot you on the spot and claim you drew first.
(Peggy, 12 May 2012 18:04)
Of course I wouldn't expect any due process in, say, Iran. Just thought that Serbia was a little bit more civilized.
----------
I am not saying this is Serbian law, but my personal opinion.
Your guys deserved it
(Peggy, 12 May 2012 18:04)
Ah, OK... So I was thinking correctly that Serbia is more civilized than your personal opinion. So they did deserve a due process in Serbia, but, of course, they did not deserve a due process in the wilderness of the Peggyland.
(icj1, 13 May 2012 01:12)
Ah, OK... got it. So according to the Serbian law people who illegally enter Serbia with the purpose of killing Serb civilians can be executed without due process... Are you sure we are speaking about Serbia and not Iran ?!!!

"War on terror" is top U.S. priority. Strangely, when Serbia is in question, U.S. top priority is tacit support to Islamic terrorism, even when it is illegal by U.S. laws. The question is - why?
I hope that this question will reach someone competent from U.S. Homeland Security who will run background check on all Department of State personnel involved in this case. Before another Ft. Hood, Ft. Dix or Frankfurt Airport happens.
The US isn't waging a war on terror, its waging a war of terror on anyone who doesn't bend to their will, those terrorists who tried to attack that US base in America were US attack Dogs who had gone Rabid on them and tried to attack their owner.
(Englishman, 12 May 2012 16:55)
And this is overlooking the fact that turnout was low, so a whole mass of people did not express their views, so we know little about their social maturity.
(Reader, 12 May 2012 02:00)
Dear Reader:
I agree with you with a 100%. I only dealt with a few Serbs in my life and the ones that I dealt with were honorable men. However I find it disturbing that on this particular topic majority of the Serb posters condone this crime and not a single Serb poster has condemned this barbarian act.
These three young men did not deserve to be executed. Whoever ordered and commited this horrible act must face justice. Taking three lives at their prime time is a horrible crime and if that person escapes human justice at the end that exact person that did this will have to face god and he'll have to answer in front of him.
As a parent I can not imagine the pain that the parents went through to have three sons buried at the prime of their lives.
(Jeff. D, 12 May 2012 16:35)
You kill innocent civilians and execute prisoners and then have the decency to complain? It doesn't surprise me. You align yourselves with countries like China, Russia, Pakistan, Venezuela, Syria, Iran and those wonderful African nations. They're all known for human rights.
And, you wonder why bombs come down on you.
(cry me a river, 12 May 2012 15:44)
By the same token, how in God's name can anyone justify taking civilians prisoners in order to harvest their organs?
(Peggy, 12 May 2012 03:00)
Nobody can justify that and if anybody commtitted those crimes, should be prosecuted and punished, with due process.
----------
These men were in the country illegally with full intention to murder Serbs regardless of them being civilians, but the Serbs whose organs were harvested were in their own country legally and not a threat to anyone.
I think I have just answered your own question. Your Albanians brothers didn't deserve any due process.
(Peggy, 12 May 2012 03:00)

"By the same token, how in God's name can anyone justify taking civilians prisoners in order to harvest their organs"?
Dear Peggy:
What you are alluding above is all speculations and allegations. Nothing to this day has been proven yet. There isnt a single piece of solid evidence to point to this monstreous crime.
Having said that I am very disturbed that you feel that these young men deserved to be executed when all they did was help their neighbor cross the border into Serbia safely. I worry very much about your state of mind.
(Jeff. D, 12 May 2012 15:15)
Well i think the Serbs should request the arrest of Bill clinton for war crimes crimes against humanity and waging aggressive war and sending Al Qaeda to Bosnia.

-Here are some generalization I can make about serbs (based on b92):
1. First to point fingers, last to accept accountability.
2. Full of 'facts', yet always with no sources.
3. Serbs are angels, non-Serbs are devils.
4. The world is out to get them....always some anti-serb conspiracy.
If you know me well you should know I keep a very close eye on the Serbian Dinar (RSD). I predict at 120, Serbia will hit a very severe economic recession....Good luck! Sincerely,(KOSO, 11 May 2012 19:03)-
Well I'm not sure about the dinar but yr 4 points are right on. it is the milosevic press, or more to the point it has become the milosevic press. they don't like it when i say it so they always censor me, just like in commie days (though i didn't write then.)
but why censor? they are what they are, they should take pride in it, right? you are what you are... my frnd says he much prefers sebia's official govt media, but i am loyal to my beloved b92 :()...
That "country" has caused nothing but trouble for your guys.
They build a statue of Bill Clinton in a ghetto looking street corner in Pristina. With Moldova and a couple other countries, it's the poorest "country" in Europe.
Do a bit of communication, and bring the Serbian enclaves back into Serbia, where they belong. You have to realize that the 1 million Albanians living in Kosovo are not going to obey under a Serbian government.
You can focus on better things. Improve relations with countries that are becoming more and more developed with you, like Croatia, while keeping good relations with your Russian fellas. You guys are already warming up to the Croats even more.
Why don't you just leave it behind and look forward to a prosperous and secure future? Today, Kosovo is nothing but a stain on the Serbian name.
(TristanFromCanada, 12 May 2012 05:19)
That's about right see treatment of Seslj and Haradinaj by international judges at the Hague...you're probably struggling with that comparison, let me help-one man accused of murder and torture,Alabanian, is allowed out, the other accused of hate speech,Serbian, has been in for 9 years and counting, without a verdict. Shocked? Me to.
(miles, 11 May 2012 14:12)
Go and complain to Russia, China & co. who put those judges there...

"I read some of the comments on this board and if this forum serves as median to measure Serbia's social maturity then Serbia as a society has a long, long long way to reach its maturity and join the rest of the civilized nations. "
Jeff D.
It is my opinion that commentators on this forum should not serve as a median to measure Serbia's social maturity. If you have noticed in the last days, most of the commentators on this forum are upset because of the recent elections in Serbia. The results of those elections, and the programs and ideologies of those parties that won should serve (among other things) as a median of Serbia's social maturity. And this is overlooking the fact that turnout was low, so a whole mass of people did not express their views, so we know little about their social maturity.

well, first of all, I am quite sure this alleged "Jeff D." is just another rather naive K-albanian who intends to provoke anti-american comments here, but to be honest, even if it was an american, it wouldn´t change a lot in regard to the lack of knowledge and the level of naivety at all.
dear "Jeff":
this forum here is certainly not a medium that could serve as a measure of political maturity, since it is only a platform of foreign-paid journalists and k-albanian trolls, so... if you count this here as a medium that serves this purpose, it would rather say something about your own individual maturity though.
furthermore, the Balkans will be at peace when KiM is liberated again, and before that happens, we have a state of occupation! you shouldn´t fool yourself about that, and you even more shouldn´t fool yourself by thinking that this temporary occupation of serbian territory is about to last, no matter wether you are an k-albanian troll or just an american laymen, you´re wrong anyway.
last but not least, what is also quite absurd, no matter wether you´re albanian or american: lecturing here about "the civilized nations" sounds quite laughable when coming from your side!
(Jovan, 11 May 2012 21:02)
jeff, how can any civlized nation expressly condone the torture of its prisoners?
should that be the civilization serbia aims to become?
(tardyTheTurtle, 11 May 2012 20:48)
Well look who's talking. Didn't we just see thousands of albanians in Macedonia defend the albanians islamist killers of the 4 macedonian youngsters? Claiming serbs and macedonians killed them. YOU need to take a look in the mirror you hypocrite.

2) As strongly as I feel against the killing of prisoners, I can't feel any sympathy for terrorists. U.S. legislation introduced to thwart enrollment of Irish-Americans into IRA was in effect in 1999 thus made the act of joining KLA by Albanian-Americans illegal, unless Albanian-Americans are "more equal" than Irish-Americans and exempt to obey U.S. laws.
Three U.S. citizens of Albanian extraction joined so called "Atlantic brigade" of KLA in Albania and entered Serbian territory illegally with the intent to take part in terrorist activities as sharpshooters. As such, they were not protected by Geneva convention. KLA was listed as terrorist organisation by the very same DOS who now acts on their behalf. They were no different than Islamic terrorists of various nationalities captured by U.S. forces in Afghanistan. Significant number of them were killed.

well, first of all, I am quite sure this alleged "Jeff D." is just another rather naive K-albanian who intends to provoke anti-american comments here, but to be honest, even if it was an american, it wouldn´t change a lot in regard to the lack of knowledge and the level of naivety at all.
dear "Jeff":
this forum here is certainly not a medium that could serve as a measure of political maturity, since it is only a platform of foreign-paid journalists and k-albanian trolls, so... if you count this here as a medium that serves this purpose, it would rather say something about your own individual maturity though.
furthermore, the Balkans will be at peace when KiM is liberated again, and before that happens, we have a state of occupation! you shouldn´t fool yourself about that, and you even more shouldn´t fool yourself by thinking that this temporary occupation of serbian territory is about to last, no matter wether you are an k-albanian troll or just an american laymen, you´re wrong anyway.
last but not least, what is also quite absurd, no matter wether you´re albanian or american: lecturing here about "the civilized nations" sounds quite laughable when coming from your side!

(Reader, 12 May 2012 02:00)
Serbia broke international laws (see Geneva Convention) by murdering at-will prisoners. What did you expect from the United States? The US Department is reacting in a formal gesture in order to rectify the situation. If two Serbs were murdered in the USA at the mercy of the US Govt while the killer walked free, Ivica and the rest of the Belgradian clowns would be throwing conferences with journalists like its the end of the world.
Serbia is not displaying European values, and here is a clear case-in-point. It is clear to all that these Americans were only murdered because they were of Albanian descent....Shame!
Perhaps when Kosovo Albanians should take responsibility for their crimes against Serbs. They never seem to do that, yet they complain and complain and complain and complain...
(Daniel, 11 May 2012 12:47)
why dont they get eulex to make arrests for the 1000s of crimes committed against Serbs. Stupid question, its the americans.

Limaj ran a dentention center in kosovo* during the war where prisoners were killed, which is a war crime, yet he was set free. Not to mention the Serb and other prisoners of war who had there organs harvested.
(robert1899, 11 May 2012 15:31)
sorry ms. nauland there is not enough evidence to make an arrest. amazing that when kosovo court just aquitted a well known war criminal for lack of evidence we heard nothing from u.s. it's these types of actions that have eroded u.s. credibility worldwide.
(Robert1899, 11 May 2012 12:46)
1) Why is the U.S. trying to help some guys that left America to go and fight in a terrorist organization. Yes, terrorist organization that even the U.S. and NATO recognized as just that. Are they going to insist the killings of 2 Americans that left to fight for the Taliban be investigated hard too?
2) As strongly as I feel against the killing of prisoners, I can't feel any sympathy for terrorists. There are many innocent civilians that were killed on both sides that need justice before terrorists do. When you sign up for a criminal organization like that, you know what you are getting yourself into.
(Steve B., 11 May 2012 15:28)

NATO and the U.S. broke international laws with the illegal bombing of Yugoslavia. Why are you not pushing for justice in this matter? How many innocent people (Serb, Albanian, Roma) died at the hands of these illegal actions?
They probably weren't killed because they were Albanians, they were most likely killed because they are terrorists that came to fight for KLA, a terrorist group (FACT).
(Steve B., 11 May 2012 15:31)
U.S. legislation introduced to thwart enrollment of Irish-Americans into IRA was in effect in 1999 thus made the act of joining KLA by Albanian-Americans illegal, unless Albanian-Americans are "more equal" than Irish-Americans and exempt to obey U.S. laws.
Three U.S. citizens of Albanian extraction joined so called "Atlantic brigade" of KLA in Albania and entered Serbian territory illegally with the intent to take part in terrorist activities as sharpshooters. As such, they were not protected by Geneva convention. KLA was listed as terrorist organisation by the very same DOS who now acts on their behalf. They were no different than Islamic terrorists of various nationalities captured by U.S. forces in Afghanistan. Significant number of them were killed.
"War on terror" is top U.S. priority. Strangely, when Serbia is in question, U.S. top priority is tacit support to Islamic terrorism, even when it is illegal by U.S. laws. The question is - why?

Tacit support of terrorism by rogue elements in American administration is an American, not Serbian issue.
Serbian issue to find out rogue elements responsible for extra-judical killing of three foreign terrorists.

Try entering any country with that intention and see if they will give you due process or just shoot you on the spot and claim you drew first.

Of course I wouldn't expect any due process in, say, Iran. Just thought that Serbia was a little bit more civilized.

I am not saying this is Serbian law, but my personal opinion.
Your guys deserved it

Ah, OK... So I was thinking correctly that Serbia is more civilized than your personal opinion. So they did deserve a due process in Serbia, but, of course, they did not deserve a due process in the wilderness of the Peggyland.

Shocked? Me to.

Go and complain to Russia, China & co. who put those judges there...
