Petition launched to revise trial of Young Bosnia members

The petition will first be offered in the Serb Republic (RS) and the Federation of Bosnia and Herzegovina (FBiH), Bosnian-born Serbian film director Emir Kusturica, who is director of the Andrić Institute, announced on Sunday.

Speaking to reporters in Andrićgrad, eastern RS, Kusturica said that the verdict resulting from the trial was not valid because the Young Bosnia members committed the assassination in occupied territory that was legally not under the sovereignty of the then Austro-Hungarian Empire.

He said that the Institute will table the petition to the Court of Bosnia and Herzegovina in Sarajevo with a request for a revision of the trial of the Young Bosnia members.

"It is logical that the revision, which is definitely going to be a long and painstaking process in the current social and political situation, should be carried out where the assassins were tried - in Sarajevo," Kusturica said.

The court before which the assassins were tried was illegal, and so was the trial itself, Kusturica said.

"What kind of a verdict was that, what kind of a court was that if it never received an appeal to the verdict, which is unprecedented in legal science?" Kusturica asked.

After the verdict was announced, lawyer Rudolf Zistler, the ex officio attorney of Princip and the Young Bosnia members, was spirited out of the court building in an oil barrel for fear of being lynched by a Sarajevo mob, Kusturica recalled.

The second issue of Historical volumes by the Institute's Department of History was presented on Sunday, documenting Zistler findings regarding the trial's serious flaws, which led him to question the legitimacy of the verdict for the Young Bosnia members.

Miroslav Perišić, a member of the Institute's International committee tasked with marking the centenary of the outbreak of World War I, said that the Historical volumes are a transcript of the defense, which has been ignored by historians and legal experts alike.

Young Bosnia was a pro-Yugoslav organization, which brought together Serbs, Croats and Muslims in the fight against the Austro-Hungarian annexation and occupation of Bosnia-Herzegovina.

In the assassination, organised by Young Bosnia, Princip fired two shots, killing Archduke Franz Ferdinand of Austria, and - by mistake - his wife Sophie, instead of Oskar Potiorek, then governor of Bosnia and Herzegovina.

In the so-called High Treason Trial in Sarajevo, the five members of Young Bosnia received death penalties, while Gavrilo Princip and Nedeljko Čabrinović were sentenced to 20 years in prison since they were underage.

Princip was chained and tortured in prison at Terezin fortress, the Czech Republic, where he died of tuberculosis on April 28, 1918, at the age of 24.
