Kosovo Albanian politician Ramush Haradinaj has filed a motion for temporary release from prison during the upcoming holiday recess. As a reason for the temporary release, the former member of the so-called KLA, who is at the Hague Tribunal accused of committing war crimes, stated that his wife was pregnant and due to give birth in mid-January. The leader of the Alliance for the Future of Kosovo (AAK) did not ask for the court’s permission to publicly engage in politics if he was temporarily released. He has been in detention unit in Scheveningen since he was arrested by EULEX in Pristina on July 20. The tribunal refused to release Haradinaj pending his new trial in September, assessing that he would influence witnesses’ willingness to appear before the court considering that “an atmosphere of witness intimidation is prevailing in Kosovo”. Accepting the prosecution’s appeal to the initial verdict which was announced in April of 2008, the chamber of appeals decided on July 21 to repeat the trial of Haradinaj and co-accused Idriz Balaj and Lahi Brahimaj on six out of 37 counts of the initial indictment. They are accused of crimes against detainees in a KLA prison camp in the village of Jablanica near Decani from March until September 1998. Haradinaj and Balaj were acquitted in the initial trial while Brahimaj was sentenced to six years in prison for cruel treatment of the prisoners in the Jablanica camp. The re-trial was ordered because two key witnesses refused to testify against the suspects after being “harassed and intimidated”. According to the indictment, Haradinaj was KLA commander since 1998 until 1999 in the Decani area, Balaj was commander of the so-called Black Eagles "special unit", while Brahimaj was "a member of the KLA headquarters and commander of the KLA prisoner camp".
