Rehn proposes ad hoc arbitration

EU Enlargement Commissioner Olli Rehn has proposed that the Croatia-Slovenia border dispute be solved through an arbitration of international legal experts. Though Rehn’s second proposal to Zagreb and Ljubljana has still to be made public, Slovenian media claim that the second proposal involves ad hoc arbitration. Rehn proposes ad hoc arbitration The arbitration group would be made up of five experts, with the European Commission proposing the leader, who would select two more arbitrators, one each proposed by Slovenia and Croatia. While Rehn’s first proposal centered on mediation between Croatia and Slovenia, the new plan for solving the border issue would leave the matter in the hands of a group of international legal experts, whose final decision would be binding for both sides. This ad hoc arbitration would meet the demands of Slovenia, which wants issues such as historical and other circumstances be taken into consideration, according to Slovenian national television. Rehn proposed that this kind of arbitration could be used to settle the border issue by the end of the year, and at the same time, called for Slovenia to lift its blockade of Croatia’s negotiations with the EU as soon as the two countries initialed the arbitration agreement. Slovenian web portal 24ur.com, based on unconfirmed reports, stated last night that Ljubljana had already rejected Rehn’s proposal and that it would not lift the blockade on Croatia’s EU negotiations until the arbitration deal was ratified by both countries’ parliaments. The Slovenian Parliament’s Foreign Affairs Committee discussed Rehn’s proposal on Tuesday, at a closed-door meeting attended by the country’s Foreign Minister Samuel Zbogar. It was stated after the meeting that the committee “has expanded the Slovenian government’s basic positions and added several suggestions as to how a positive answer to Rehn’s initiative would have to look,” though no details were given.
