Verdict in Bytyqi case appealed

The War Crimes Prosecutor’s Office has appealed the verdict which cleared Sreten Popovic and Milos Stojanovic of war crimes charges in the Bytyqi brothers case. The Prosecutor’s Office has decided to appeal due to significant violations of criminal proceedings. The two ex-police officers were acquitted by the Belgrade District Court War Crimes Trial Chamber on September 22, 2009. Verdict in Bytyqi case appealed According to the initial indictment, Popovic and Stojanovic were accused of “being accomplices in the murder,” but they were accused of violating the right to a fair trial and torture by the subsequent indictment. The Bytyqi brothers were killed in Petrovo Selo on July 9, 1999. Their remains were found two years later. Brothers Ilir, Argon and Mehmet Bytyqi were U.S. citizens of Albanian origin and members of the so-called Atlantic Brigade, which worked with the Kosovo Liberation Army (KLA). They were arrested in late June 1999 for illegally crossing of Yugoslavian border. The brothers were sentenced to 15 days in prison by the local court in Prokuplje, but were taken to Petrovo Selo and killed four days before the end of their sentence. Trial Chamber Chairman Vesko Krstajic explained that “the crimes described in the indictment from September 3, were not proven during the presentation of evidence in the case.” “After questioning over 50 witnesses and forensics experts we have come to a conclusion that the crimes Popovic and Stojanovic have been accused of have not been proven,“ the chairman of the trial chamber said. He stated that the Bytyqi brothers had been prisoners of war and that this why the arrest made by the two officers could not have been illegal. However, Krstajic said that the ’’disturbing fact remains that three young men died and that it is completely unclear why and who requested it.“ The trial of Stojanovic and Popovic started on November 13, 2006.

According to the initial indictment, Popović and Stojanović were accused of “being accomplices in the murder,” but they were accused of violating the right to a fair trial and torture by the subsequent indictment.

The Bytyqi brothers were killed in Petrovo Selo on July 9, 1999. Their remains were found two years later.

The trial of Stojanović and Popović started on November 13, 2006.
