A lawyer representing the plaintiffs in the Marko Milosevic assault case has lodged an appeal against his acquittal. Milosevic, son of former Yugoslav President Slobodan Milosevic, was charged with the assault of three Otpor activists in Pozarevac in 2000. Appeals lodged in Marko Milosevic case Dusan Cvejic, representing Momcilo Veljkovic, Nebojsa Sokolovic and recently deceased Radojko Lukovic, has appealed against the first instance verdict of the Pozarevac District Court, according to which Marko Milosevic and five of his associates were cleared of inflicting grievous bodily harm on the Pozarevac Otpor activists outside the Pasaz café on May 2, 2000. Veljkovic said that the appeal submitted on July 17 concerned breaches of criminal procedure, wrongful and incomplete review of evidence, and breaches of the Criminal Code. On June 10, Judge Gordana Vidojkovic acquitted Milosevic and his five associates of all charges due to a lack of evidence. The judge explained that there was no doubt that a fight had occurred, but that it had not been proven that the defendants had inflicted grievous bodily harm on the plaintiffs, and that there was no evidence to indicate who had inflicted what injury on whom during the fight. The three Otpor activists were also cleared of any charges because the criminal act had expired. One of the witnesses in the case, Miroslav Milosevic from Pozarevac, who testified that during the incident Marko Milosevic had chased him through downtown Pozarevac, said that he had had all the police on Tuesday because he had received anonymous threats via his mobile phone. Miroslav Milosevic said that he had received three text messages on his mobile saying“Sleep peacefully, because when the new dawn rises you won’t”, “I am waiting for you on the bridge, Marko”, and “I got you—truck driver from Loznica”. The messages referred to the recent traffic accident in which journalist Mile Veljkovic and Lukovic were killed. Milosevic said that he had received a number of threats from that phone number, and that he had notified Pozarevac police.
