The Hague Prosecution has asked the Court to order the arrest of former Bosnian Army commander Rasim Delic. The prosecution has requested the arrest because, during his temporary release, Delic met with the Muslim member of the Bosnia-Hercegovina Presidency, Haris Silajdzic. Hague orders Bosnian defendant's immediate return Delic’s defense team objected to the motion claiming that he had not spoken with Silajdzic about the trial and that he had not been able to turn down the official’s invitation. The general is being tried at the Hague Tribunal for crimes committed against Croat and Serb prisoners by mujaheddin within the ranks of the Bosnian Army in 1993-94. According to yesterday’s submission by the prosecution, by meeting Silajdzic, he had broken the conditions of his temporary release, as their conversation had included discussion of the course of the trial. Moreover, according to the indictment, Delic is forbidden from appearing in public, and his meeting with the official was reported in the press. The general’s lawyers, however, claimed that Silajdzic had asked Delic about the trial at the beginning of their conversation, but that the latter had told him that he was not allowed to speak about the matter. According to the defense, the actual subject of the conversation had been Delic’s health and how Silajdzic could help him. Even if the Court could prove that the general had broken the conditions under which he was released, his representatives do not feel that such an infringement warrants his arrest and return to the Hague, especially given the fact that he surrendered to the Tribunal of his own accord. Presiding Judge Bakone Moloto will rule on the prosecution’s motion. Rasim Delic (FoNet, archive)
