The defense had complained that it could not gain access to the statements some witnesses had given the UNMIK prosecution about the events Haradinaj, Balaj and Brahimaj are charged with.The defense counsel said there might be some “potentially exculpatory material” in those statements, although they could not claim that with certainty, given that they have not seen the statements.
The UNMIK representatives today explained that they were not opposed to cooperating with the defense. The organization’s policy was not to contact the defense counsel directly but through the prosecution.
An agreement was reached that the UN administration in Kosovo would respond to defense requests, but only if the appropriate procedure was complied with. They must be filed in the Hague Tribunal records. According to them, this will make enable the Trial Chamber to monitor the defense motions.
