Defense: Milutinović like English queen

Marković is testifying in Milutinović’s defense. He went a step further today, comparing the office of the Serbian president with the role of the English queen: it neither has the power to appoint the cabinet nor to dissolve the parliament.

Prosecutor Thomas Hannis confronted the witness with a number of claims indicating that the Serbian president could have done much to prevent the crimes during the conflict in Kosovo.

One of the tools in Milutinović’s hands was the power to demand a report on the activities of the ministries from the government, the prosecution contends.

The Serbian president could thus have sought information about the excessive use of force by the police in Kosovo and the crimes it committed against the Albanian civilians once he had received reports about them from the international mediators in 1998 and 1999.

Marković admited that Milutinović could have availed himself of this mechanism to exert control over the government and Interior Ministry, but he says he could not have done anything if he were unhappy with the government report except resign.

The prosecution alleges that Milan Milutinović did not resign and failed to do anything to prevent the crimes against the Kosovo Albanians and punish the perpetrators in 1999.

The prosecutor wanted to get the witness to clarify an article in the Serbian Constitution stipulating that the president was in charge of the foreign affairs and was the commander of the Serbian armed forces.

Marković explained that the article had never been implemented because those spheres had been covered by the federal constitution. It was put in there in case all the republics broke away from Yugoslavia, leaving Serbia on its own.

“We waged war through the constitutions,” Marković said, adding that it was better than waging it with weapons. Far less people were killed in the war they waged than in the American civil war, he said.

Marković’s testimony will continue on Monday.
