Think About It who stated "A new judge has been appointed due to Seselj's objections" is in fact wrong. The Judge was indeed dismissed and fired from the Tribunal, but Seselj like any other competent Jurist, claimed a mistrial and asked for a retrial or release. At no point did his objections request "a new judge be appointed". As a matter of fact, the appointment of a new Judge at this point in the proceedings is not supported by the rules and procedures of the ICTY itself. Seselj's objection to the appointment of a new Judge was rejected by the trial chamber last year and on Friday June 6th, the Appeals Chamber, with dissension, rejected the appeal.
The decision of the Appeal Chamber is laughable. No competent lawyer can argue against a mistrial in this case, as the argument defies the plainly obvious. Although I have no doubt that the ICTY Judges may one day repeal the Law of Gravity, objects will still fall to earth.
