Insider author reveals she was sued

B92 TV's Brankica Stanković revealed on Thursday during a Profemina gathering that Luka Bojović sued her last month for publishing official notes.

I don't see how Luka Bojović would have any legal standing to sue Brankica Stanković. Even if what she did would turn out to be illegal, which I doubt because journalists can publish classified information in certain cases (this likely being one of them), this alleged illegal publication of secret documents is something between the state of Serbia and Brankica Stanković.

If the Serbian state would like to sue Stanković, it might have standing. However, if the "secret" documents were given to Stanković without a strict order to keep them secret, they automatically stopped being "secret" at that moment. Bojović has simply no legal standing against Stanković, for he has no authority regarding the “secrecy” of those documents.

If he likes to, Bojović could sue the Serbian state if he thinks they wrongfully gave documents to Stanković. But considering these same documents show that Bojović ordered the murder of the person those documents were given to, I don't think such a claim will survive in that case either.

Also, I think the lawyer involved in this case has to be perfectly aware of the above as well. That means this lawyers is knowingly and willfully abusing the legal system in order to intimidate someone. Not that such a thing is anything new or uncommon. But still, if cough demonstrably doing so, a serious offense for a lawyer. Maybe the Serbian equivalent of the Bar Association should have a good look at this lawyer.
