With allies in the Security Council, the only part of the UN that actually has any weight, Serbia could have gotten recommendations from Russia and China for the UN to look into the matter.

Now the Western governments in the Security Council would have denied this
(Ari Gold, 1 April 2014 13:55)

The above sounds confusing... which statement is true, the first or the second as they are in contradiction with each other?! In one you say Serbia can get the recommendation and in the other you say that Serbia can't get the recommendation...

That's not it at all. Who is ultimately serving as the "judges' of this procedure? EULEX is. This means the truth is highly compromised before trials even begin. Do you expect this "court" to "find out" what we already know regarding the magnitude of Albanian war crimes and most specifically, the organ harvesting and trafficking? EULEX countries participated in aiding and abetting KLA terrorists, are they really going to convict themselves?
(Ari Gold, 31 March 2014 10:42)

Indeed, the above is a demonstration of the fact that this is an exercise in futility. Our dear friend Ari Gold, will ask for a 4th, 5th, 6th... Nth investigation until the results match what he/she has in his/her mind.
----------

Of course there was/is an option for the UN to take a look at the matter. But the EU doesn't want that (obviously), they want to be the sole judges in the matter. The Serbian gov't again buckled to not let the UN have a say on the matter, choosing to only work in collaboration with the governments who helped the terrorists in the first place.
(Ari Gold, 31 March 2014 10:42)

The UN has done that in the past and has been dismissed by Serbs as "biased". So, as I said before, all of this (whether it's the UN or somebody else) is an exercise in futility. Our dear friend Ari Gold, will ask for a 4th, 5th, 6th... Nth investigation until the results match what he/she has in his/her mind. Obviously it's inconceivable for Serbs to just be wrong :)

You just repeated what I said, Russia could have suggested it, China maybe, but the west wants the whole matter moved to the EU, so it would have been a discussion that would never come to a vote, other wise they would have just extended the mandate of the ICTY. Serbia had no influence in the matter so they DID NOT hand it over. A lot of what Serbia approves is just for internal press, such as EULEX Serbia says definitely not, never will it take over Kosovo, then after it was realized that personnel were hired, core staff, in place, equipment being delivered, and transfer of files from UNMIK taking place and most UNMIK personnel not joining EULEX with plane tickets in hand, Serbia agrees and welcomes EULEX.

Don't hold your breath, I wouldn't be surprised if the kangaroo court does not implicate Serbian involvement. The EU/US got pinned by Marty's disclsure and this is the best way out. They will show the world that they did something about it only to acquit those involved.

Not true. With allies in the Security Council, the only part of the UN that actually has any weight, Serbia could have gotten recommendations from Russia and China for the UN to look into the matter. Now the Western governments in the Security Council would have denied this given that they only want EULEX to handle the proceedings (go figure), but the point is by handing this off to EULEX, Serbia handed away any possible chance of a fair and just investigation.

Even if there was a chance that there was enough evidence to convict someone of these crimes in which there are no victims (No one has ever given a name of an actual victim) have you seen what the sentences handed down to Serbs for war crimes. 5 years, 9 years etc. Its a joke and any one convicted in an organ harvesting conspiracy is not going to get more and then the appeals always reduces it.
If you are looking for someone to hang--best to go to China, and then those are usually political prisoners.

I love these ridiculous comments everytime I hear them. Lets see the UNSC set up the ICTY to look into the matter, result not enough evidence to pursue the matter. UNMIK in which the first 2 letters stand for "United Nations" investigated the matter and decided there was not enough evidence to pursue the matter.
But diehard Serbs who are desperate to keep the matter alive, claim it is not the EU that should be investigating but rather the UN who twice before have said there is no case that should decide it.
After all if it were not for the EP taking the action of saying there should be an investigation the matter would be a dead issue. Do you really believe there would be another decision to come out of the UNSC to do a third investigation(especially considering the fact that the very people you claim are railroading the investigation, have 3 potential vetos to repeating it)
Sometimes it seems people just want to argue without having a reason to argue.

I have no faith in any sham EU court. Its clear that they are more concerned with running things, and how things look, than they are about getting to the truth. Responsibility for these actions is not limited to the individuals who did them, responsibilty extends to the countries that armed the criminals. It is more likely than not that there will be no convictions, and if there are convictions, it will be very low level individuals who they court will say were "acting alone"

Zoran

The evidence was always there and it has been well known within the international community that organ harvesting did occur. The question was whether the US had the will to prosecute its allies or to keep it covered up. Also, the question still remains, to what extent?

Now that they are talking about setting up a court in the Hague, it is obvious they have enough evidence to justify creating such a court. However, as we can see, since it is all being done behind closed doors, with no transparancy, it will be a fudged outcome with a lot of the truth hidden.

Serbia committed ethnic cleansing and genocide in Bosnia, Croatia and Kosovo i Metohija. The wars in Yugoslavia were mostly one-sided Serbian aggression and the Western governments were forced to intervene on behalf of the innocent victims to stop Serbian thugs.

^That is what you believe when you support EU membership for Serbia. That's just the political side of it, there are even more social and economic reasons why it would be disastrous for Serbia to join the EU.

"To provide adequate protection of witnesses and other participants in the process would be impossible in Priština, Tanjug’s source said."

To provide a fair trial against the Kosovo Albanian mafia a.k.a. 'freedom fighters' a.k.a. KLA will never be possible in Kosovo where police and judges are recruited from the same groups these crimals belong to. In a society where clan loyalty and blood feud is the base of 'law' and criminals have prominent places in the 'government', you cannot expect anything like that.
