Novak's visa case is straightforward: The Federal Court of Australia gives a ruling that Novak Djokovic can remain in Australia for the period of his visa. Then came the government decision to cancel Novak's visa, given on Friday, 14/01/22 just before 6.00pm. One should know that the Australian democratic system is based on the British system including its legal system. Here in Novak's dispute, there was a court decision; there should not be a government's decision which rules on the same dispute. The government only can appeal the Federal Court of Australia's ruling on Novak Djokovic's case to a higher court, the High Court of Australia. It cannot make an executive decision that overrides the established judicial decision. Unless Judge Anthony Kelly was in cahoots with the government the challenge of the Federal Court of Australia's ruling on Novak Djokovic's visa by the decision of Alex Hawke, the Immigration Minister, should have been brought before the High Court of Australia where his decision can be tested and judged if it is constitutional to override the Federal Court of Australia's ruling. But this did not happen! As it can be seen here the Australian government has no regard for the rule of law, the judiciary is timid. How can this happen? Maybe that is due to the Australian electoral norm - the government, the opposition and the independents get together at election and fix who is in who is out of the parliament. This has been going on for decades in Australia.
