The ICJ’s response was the most benign answer you could get. Its said the physical act of Kosovo parliament declaring independence was not illegal, and that is true since its not covered by any international law but even that decision was not unanimous since other judges saw what should be also said. However, if you grease enough palms you get the right answer.

You have no idea what an advisory opinion means in legal terms. An advisory opinion is an opinion issued that has NO LEGAL status, bearing or standing; it’s only an opinion on the legality of an issue.
Since the international law did not cover the act of declaration – that is if you stood up in Sarajevo and declared it independent from BiH then that is not illegal since international law is silent on the issue, but the separation is a matter for international law.
The question asked by Serbia was already prepared by the west knowing full well what the answer would be, so Tadic et al were paid handsomely to have it asked. Tadic has investments throughout Europe; a home near Ivo Senadar in Austria; another in Switzerland. He became very wealthy overnight and I have dealt with people like him and know exactly how it works.
Why didn’t the US allow the real question to be asked? The danger was that the ICJ would rule it’s was illegal then they would pay enormous reparation. If on the other hand the ICJ ruled yes it was legal then all that wished to leave and become a country could do it legally – Spain would lose Catalonia and the Basque regions; and so on etc. It could fracture Europe into pieces let alone elsewhere and in the future the US itself.
The west aka will never allow Serbia to go back to the IJC. These international institutions are controlled by the west regardless what they say about them being beyond reproach.

SJ: It seems odd in view of what you say that Serbia didn't seek to nail this issue down once and for all when it went to the ICJ. If the situation is as open as you suggest there was no point at all in Serbia going before the court because even a positive 'opinion' wouldn't have resolved the issue. What Vucic and others need to do is deal with reality; Kosovo is gone and not coming back. Talks about compromise are pointless. The reaction in Belgrade on the day of the declaration of independence showed the world that whatever Vucic and others might say, a large number of ordinary Serbs hate Albanians and the idea that Kosovo could in any way fall under Belgrade's influence again is pie in the sky. Milosevic wanted to subjugate all Kosovo Albanians to his will and he had majority support among his people for such an approach. They, on the other hand, did not wish to be considered in any way secondary in importance and chose to go their own way. A solution for Northern Kosovo is all that could possibly be talked about now with any real seriousness; everything else is over.

An advisory opinion is an opinion issued by a court that merely advises on the legality or interpretation of law much like you would go to a lawyer seeking advice on the legality of an issue.

The International Court’s advisory opinion stated that the physical act of making a declaration of independence did not violate international law since there are no provisions under international law that prohibits the physical act of declaring independence. However, the issue of Kosovo separating from Serbia is another legal matter that is covered by international law. Therefore, the Court did not validate Kosovo’s independence with its advisory opinion.


Law has many fine points so it’s not as simple as just Albanians or anyone else repeating like parrots that Kosovo's declaration of independence was not illegal and thus implying Kosovo’s independence has been validated in the eyes of international law. It has not.

For Kosovo to be independent in accord with international law it needs to seek a ruling, note ruling, from the International Court to the effect that Kosovo is an independent state. If that is achieved, then Serbs cannot claim any illegalities. It would be all over for the Serbian case.

I watch with great interest how other governments in the former Yugoslavia are improving the daily lives of their citizens. Let’s start with Slovenia and Croatia; both were touted as the richest parts of former Yugoslavia.
Croatia would become another Chad if they did not have access to the EU fund with putting in 1 billion euros and taking out 3 billion. In the last couple of years about 260,000 have left Croatia leaving a population under 4 million. No jobs.
Slovenians have been demonstrating over their falling standards and it’s a country that borders Italy and Austria and if not for a large section working in these countries Slovenia would look even worse than Montenegro, which is another “success” story that would collapse if not for handouts from the EU.
Meanwhile investment is coming into Serbia is huge with the latest being ZF Germany – auto parts is building a 160 million euro facility. Stage 1 will be finished in February 2019 and 500 to be employed then. Other industries that complement ZP production have already sought space in the industrial zone. In all over 1,000 jobs. 100 positions will be in the research and development division.

Gorenje is now Chinese and that will leave Slovenia in 3 years except a small component to remain there.

Serbia has secretly agreed to recognize Kosovo, provide Pristina agrees to implement everything that has been agreed upon in Brussels. This will become effective before Jan. I, 2019. However, gaining membership to the EU was not part of the Brussels agreement and is an entirely separate situation.

Politicians have been seeking this so called 'compromise' for years but it doesn't exist. Either Kosovo is independent or it isn't.

As for the ICJ ruling, it seems completely bizarre to make a request of this court and to drum up support within the UNGA for such a hearing only to dismiss the outcome as irrelevant. Had the court declared that independence had been illegally proclaimed we would be hearing about it on a daily basis. Kosovo is gone and won't return with or without force within my lifetime or that of Vucic.

It's such a shame that so much time, money and energy is wasted on this issue when there are so many more pressing issues for the Government to deal with to improve the daily lives of its citizens.

Law has many fine points so it’s not as simple as just Albanians or anyone else repeating like parrots that Kosovo's declaration of independence was not illegal and thus implying Kosovo’s independence has been validated in the eyes of international law. It has not.

For Kosovo to be independent in accord with international law it needs to seek a ruling, note ruling, from the International Court to the effect that Kosovo is an independent state. If that is achieved, then Serbs cannot claim any illegalities. It would be all over for the Serbian case.

SJ: It seems odd in view of what you say that Serbia didn't seek to nail this issue down once and for all when it went to the ICJ. If the situation is as open as you suggest there was no point at all in Serbia going before the court because even a positive 'opinion' wouldn't have resolved the issue. What Vucic and others need to do is deal with reality; Kosovo is gone and not coming back. Talks about compromise are pointless. The reaction in Belgrade on the day of the declaration of independence showed the world that whatever Vucic and others might say, a large number of ordinary Serbs hate Albanians and the idea that Kosovo could in any way fall under Belgrade's influence again is pie in the sky. Milosevic wanted to subjugate all Kosovo Albanians to his will and he had majority support among his people for such an approach. They, on the other hand, did not wish to be considered in any way secondary in importance and chose to go their own way. A solution for Northern Kosovo is all that could possibly be talked about now with any real seriousness; everything else is over.

You have no idea what an advisory opinion means in legal terms. An advisory opinion is an opinion issued that has NO LEGAL status, bearing or standing; it’s only an opinion on the legality of an issue.
Since the international law did not cover the act of declaration – that is if you stood up in Sarajevo and declared it independent from BiH then that is not illegal since international law is silent on the issue, but the separation is a matter for international law.
The question asked by Serbia was already prepared by the west knowing full well what the answer would be, so Tadic et al were paid handsomely to have it asked. Tadic has investments throughout Europe; a home near Ivo Senadar in Austria; another in Switzerland. He became very wealthy overnight and I have dealt with people like him and know exactly how it works.
Why didn’t the US allow the real question to be asked? The danger was that the ICJ would rule it’s was illegal then they would pay enormous reparation. If on the other hand the ICJ ruled yes it was legal then all that wished to leave and become a country could do it legally – Spain would lose Catalonia and the Basque regions; and so on etc. It could fracture Europe into pieces let alone elsewhere and in the future the US itself.
The west aka will never allow Serbia to go back to the IJC. These international institutions are controlled by the west regardless what they say about them being beyond reproach.

I watch with great interest how other governments in the former Yugoslavia are improving the daily lives of their citizens. Let’s start with Slovenia and Croatia; both were touted as the richest parts of former Yugoslavia.
Croatia would become another Chad if they did not have access to the EU fund with putting in 1 billion euros and taking out 3 billion. In the last couple of years about 260,000 have left Croatia leaving a population under 4 million. No jobs.
Slovenians have been demonstrating over their falling standards and it’s a country that borders Italy and Austria and if not for a large section working in these countries Slovenia would look even worse than Montenegro, which is another “success” story that would collapse if not for handouts from the EU.
Meanwhile investment is coming into Serbia is huge with the latest being ZF Germany – auto parts is building a 160 million euro facility. Stage 1 will be finished in February 2019 and 500 to be employed then. Other industries that complement ZP production have already sought space in the industrial zone. In all over 1,000 jobs. 100 positions will be in the research and development division.

Gorenje is now Chinese and that will leave Slovenia in 3 years except a small component to remain there.

The International Court delivered an advisory opinion, not a ruling on Kosovo's declaration of independence. An advisory opinion is an opinion issued by a court that merely advises on the legality or interpretation of law much like you would go to a lawyer seeking advice on the legality of an issue.

The International Court’s advisory opinion stated that the physical act of making a declaration of independence did not violate international law since there are no provisions under international law that prohibits the physical act of declaring independence. However, the issue of Kosovo separating from Serbia is another legal matter that is covered by international law. Therefore, the Court did not validate Kosovo’s independence with its advisory opinion.

Politicians have been seeking this so called 'compromise' for years but it doesn't exist. Either Kosovo is independent or it isn't.

As for the ICJ ruling, it seems completely bizarre to make a request of this court and to drum up support within the UNGA for such a hearing only to dismiss the outcome as irrelevant. Had the court declared that independence had been illegally proclaimed we would be hearing about it on a daily basis. Kosovo is gone and won't return with or without force within my lifetime or that of Vucic.

It's such a shame that so much time, money and energy is wasted on this issue when there are so many more pressing issues for the Government to deal with to improve the daily lives of its citizens.

Serbia has secretly agreed to recognize Kosovo, provide Pristina agrees to implement everything that has been agreed upon in Brussels. This will become effective before Jan. I, 2019. However, gaining membership to the EU was not part of the Brussels agreement and is an entirely separate situation.

Its said the physical act of Kosovo parliament declaring independence was not illegal, and that is true since its not covered by any international law but even that decision was not unanimous since other judges saw what should be also said. However, if you grease enough palms you get the right answer.

Your beloved president and the supreme commander in chief Vučić doesn't agree with you. He said that ICJ decision gives him nightmares.
