Supplement to the criminal complaint against Bojović and Milošević in connection with the canopy's fall filed
The Supreme Public Prosecutor's Office, Public Prosecutor's Office for Organized Crime and the Higher Public Prosecutor's Office in Novi Sad submitted a supplement to the criminal complaint against the former officials of the company "Railways Infrastructure".
This concerns former officials of the company "Infrastrukture Železnice Srbije" AD Belgrade, Nebojša Borović and Milutin Milošević.
Last week, a criminal complaint was filed against Bojović and Milošević to these prosecutor's offices due to the existence of grounds for suspicion that they committed the criminal offense of abuse of official position, and in connection with the fall of the canopy at the Railway Station in Novi Sad on November 1, 2024, claiming the lives of 16 people.
One of the applicants of the criminal report, MP Uglješa Mrdić, today, as we unofficially learn, submitted an amendment to the report, which primarily refers to Bojović, who, like Milošević, was not even questioned as a witness in the proceedings that are being conducted before the High Public Prosecutor's Office in Novi Sad due to the aforementioned tragedy, the media write.
Let us recall that the documentation they signed, which was attached to the submitted application, undoubtedly indicates that Bojović, at that time the president of the assembly of AD "Infrastrukture železnice Srbije" AD Belgrade and Milutin Milošević, at that time the executive director of the same company, undoubtedly and expressly guaranteed the safety of traffic and the safety of passengers at all station buildings, including the railway station in Novi Sad.
Both of them stopped performing these functions in the meantime, and Bojović is a regular professor at the Faculty of Traffic in Belgrade and vice-rector of the University of Belgrade.
In the addendum to the criminal complaint, it was indicated that the procedure for the implementation of the project in question proceeded in such a way that before Annexes 1, 2, 3 and 4 of the Commercial Agreement on the Reconstruction and Modernization of the Hungarian-Serbian Railway on the section Belgrade - Novi Sad - Subotica (Kelebija border crossing) were adopted by the Government of the Republic of Serbia, these annexes had to be approved by the Assembly of Shareholders of "Infrastrukture Zeleznica Srbije" presided over by the President of the Assembly - Nebojša Bojović.
The meeting of the Shareholders' Assembly of the Serbian Railway Infrastructure was held a few days before the Government session, and without that decision the Government could not even adopt the annexes, since the decisions of the Infrastructure Shareholders' Assembly are an integral part of the Government's decision approving the annex to the contract.
In the supplement to the statement, which our editors had access to, the applicant states that "the first document is letter number 6/2022-402 dated 08.12.2022, signed by Nebojša Šurlan, the president of the Board of Directors, the subject of which is the Proposal for a decision on the acceptance and signing of Annex 2".
From this, as he further states, it clearly follows that the Board only proposes a decision, i.e. it is not competent to make a decision, but on the proposal of the "Infrastructure of Railways of Serbia" Committee, led by Bojović, on the basis of that proposal, it can make a decision, which is formally and legally, as already stated, necessary for the Government of the Republic of Serbia to make a decision".
"According to the above, on the same date, 8.12.2022, the President of the Assembly Nebojša Bojović issued decision number 5/2022-458-182 accepting the annex," the supplement to the application states.
The applicant believes that from all of the above, a "logical conclusion" is imposed that, on behalf of the Investor, the only body that decided on the acceptance of annexes 1, 2, 3 and 4 was the Shareholders' Assembly, and which decisions were signed by Nebojša Bojović in his capacity as the President of the Assembly, and which decisions were the relevant basis for the Government of the Republic of Serbia to make a decision based on them.
According to the previously filed criminal complaint, we remind you, Bojović and Milošević are accused of having, over a long period of time ending on November 1, 2024, in Belgrade, in their capacity as officials, by using their official positions and powers, by exceeding the limits of their official powers, seriously violated the rights of others, even though they were aware that by not complying with the regulations and technical rules on protection measures, they could cause danger to people's lives and bodies, nevertheless, they agreed to do so, keeping in mind that it would not result in death or serious bodily injury to more people.
Bojović was reported because he caused a danger to the life and body of people by not complying with the regulations and technical rules on protection measures, so that as the president of the Shareholders' Assembly of "Infrastrukture Zeleznice Srbije" AD Belgrade, he managed the aforementioned company and signed the Decision and Report on the degree of compliance of planned and implemented activities from the business program of "Infrastrukture Zeleznice Srbije" AD for the year 2024 no. 5/2024-548-218, dated July 26, 2024.
He also signed the Decision and Report on the degree of compliance of planned and realized activities from the business program "Infrastructure of the Railways of Serbia" J.D. for the year 2024 no. 5/2024-540-214, dated April 29, 2024, the media write.
These decisions and reports has, as stated in the criminal complaint, confirmed that he was familiar with all aspects of the project for the modernization and reconstruction of the Hungarian-Serbian railway connection on the territory of the Republic of Serbia for the section Novi Sad - Subotica - state border (Kelebija).
Moreover, Bojović was reported because in November 2023, he signed a decision authorizing this company to sign an Agreement on the use of public railway infrastructure with the company "SrbijaVoz" AD, thereby guaranteeing that trains can run safely on the tracks and that the stations used for the entry and exit of passengers at those railway stations are safe.
In this way, passengers in railway traffic were able to use the station building of the Railway Station in Novi Sad, including the lobby of Wing B, after which on November 1, 2024, the canopy collapsed to the ground in front of the front facade of the mentioned lobby, resulting in the death and serious injury of a large number of people.
Milutin Milošević is charged with the criminal complaint that, as the executive director of "Infrastructure of the Railways of Serbia" AD Belgrade, in charge of public railway infrastructure, he wrote Telegram number 138 f, dated March 18, 2022, by which rail traffic was put into operation on the Belgrade Center - Novi Sad line on March 19, 2022, even though construction work was being carried out on the reconstruction, adaptation and rehabilitation of the station building in the Railway Station in Novi Sad, while telegram number 8F, signed on behalf of the company "Infrastrukture železnice Srbije" AD Belgrade, was signed by M.J., the manager for traffic affairs whose superior was Milošević.
With that telegram, the company "Infrastrukture železnice Srbije" AD Belgrade, i.e. its Transportation Sector, which was under the control of the reported Milošević, confirmed the right of the company "SrbijaVoz" to organize the traffic of passenger trains, i.e. the reception and dispatch of passenger trains, the use of the Novi Sad Railway Station during its reconstruction, as well as the use of all its capacities, thereby guaranteeing that trains can safely travel on the tracks and that the stations used for the entry and exit of passengers at railway stations are safe.
In this way, as stated in the complaint, passengers in railway traffic were able to use the station building of the Railway Station in Novi Sad, including the lobby of wing B.
In addition, Milošević, as the executive director in charge of public railway infrastructure, did not issue orders for regular and extraordinary inspections of the facilities of the station building of the Railway Station in Novi Sad, in accordance with Article 21 in connection with Article 19 paragraph 3 of the Rulebook for Building Structures (Official Gazette of the RS" no. 29/19, 52/20 i 122/20), which failed to notice that corrosion occurred at the junction of the tie rod and the roof rack.
As a result of the above, on November 1, 2024, there was a complete failure of the tie rod and the appearance of a rigid fracture and collapse of the canopy to the ground in front of the front facade of the lobby B of the station building, which resulted in the death and serious injury of a large number of people, it is stated in the criminal report submitted to the Supreme Public Prosecutor's Office by MPs Djordje Komlenski and Uglješa Mrdić.
However, let's recall that the fact that both of the reported persons were recently photographed together with Mladen Nenadić - the chief public prosecutor of the Public Prosecution for Organized Crime, who is leading the investigation in connection with the financing of the reconstruction of the Railway, is still worrying.
This photo opened many questions in the public concerning the legal actions of not only Supreme Public Prosecutor's Office VJT in Novi Sad, but also Public Prosecution for Organized Crime, which prosecutions did not include either Bojović or Milošević from the investigation and pre-investigation procedures as both witnesses and defendants.
