3460. With regard to the evidence presented in this case in relation to Slobodan Milošević and his membership in the Joint Criminal Enterprize, the Chamber recalls that he shared and endorsed the political objective of the Accused and the Bosnian Serb leadership to preserve Yugoslavia and to prevent the separation or independence of BiH and co-operated closely with the Accused during this time. The Chamber also recalls that Milošević provided assistance in the form of personnel, provisions, and arms to the Bosnian Serbs during the conflict.11026 However, based on the evidence before the Chamber regarding the diverging interests that emerged between the Bosnian Serb and Serbian leaderships during the conflict and in particular, Milošević’s repeated criticism and disapproval of the policies and decisions made by the Accused and the Bosnian Serb leadership,11027 the Chamber is not satisfied that there was sufficient evidence presented in this case to find that Slobodan Milošević agreed with the common plan.

The entire case against Milosevic and Karadzic was built around the premise of a “Joint Criminal Enterprise” (that Karadzic and Milosevic conspired together to cleanse Bosnia and create a “Greater Serbia” – an accusation that was dropped against Milosevic even during his trial).

I believe it was very difficult for the prosecutors to prove that it was Milosevic who gave the orders for all those massacres against Croatians, Muslims and Albanians.

Guys like Milosevic are too smart to sign orders for killing people. They use pawns, guys like Karadzic, Mladic, Arkan etc, people lacking any human nature inside them, who can carry all the "dirty jobs" only by verbal orders.

But we all know that Karadzic and Sesejl told the truth when they said that everything was organized in Belgrade, because nothing could be carried in Bosnia, Croatia or Kosovo without Milosevic`s support and approval.

The entire case against Milosevic and Karadzic was built around the premise of a “Joint Criminal Enterprise” (that Karadzic and Milosevic conspired together to cleanse Bosnia and create a “Greater Serbia” – an accusation that was dropped against Milosevic even during his trial).

Paragraph 9 of the indictment against Karadzic says: "Radovan KARADZIC participated in an overarching joint criminal enterprise to permanently remove Bosnian Muslim and Bosnian Croat inhabitants from the territories of BiH claimed as Bosnian Serb territory by means which included the commission of [crimes]." And in Paragraph 11 the indictment asserts that "Radovan KARADZIC acted in concert with other members of this criminal enterprise including [...] Slobodan MILOSEVIC".

Conversely, paragraph 6 of the indictment against Milosevic says: "Slobodan MILOSEVIC participated in the joint criminal enterprise [...] The purpose of this joint criminal enterprise was the forcible and permanent removal of the majority of non-Serbs, principally Bosnian Muslims and Bosnian Croats, from large areas of the Republic of Bosnia and Herzegovina, through the commission of crimes." And in Paragraph 7, "The individuals participating in this joint criminal enterprise included Slobodan MILOSEVIC, Radovan KARADZIC, [etc ...]".

The charges against Milosevic and Karadzic have been linked for the Hague for all these years and no proof exists on Milosevic...

The albanians have many monuments dedicated to former war criminals and KLA terrorists.
Having a monument set up to Milosevic is a great way for both communities to heal and for the Serbs and the albanians to come together and admire all his good deeds in Kosovo.

War Crimes Prosecutor Geoffrey Nice, condemns revisionist accounts of Milosevic/Serbian war crime guilt:
Nice has told Radio Free Europe that those attempts amount to "extracting a single sentence (from the Karadzic verdict) out of context." He at the same time emphasized that the trial of Radovan Karadzic was not the trial of Milosevic.
The British jurist believes that such allegations made by British journalist Neil Clark are "probably a part of a campaign orchestrated from Serbia - or, possibly, from Russia."
Nice claims that, although all sides committed war crimes, it is "a simple and irrefutable fact" that it was "Serbia" that committed by far the most crimes during the conflicts of the 1990's - "both by number and severity" - and that they "lead to Milosevic."
According to him, this is something that was also concluded by the trial chamber at the end of the presentation of the prosecution's evidence - "but Milosevic's death prevented a verdict."

Milosevic was a communist who believed that some kind of Yugoslavia was the only hope for the region. He didn't understand, or wouldn't, that the SFRY was what laid the foundations of what came. He was proud to be a Serb and claimed to defend the Serbian people, but would not come to terms with what was obvious to everyone else, that nothing like the former Yugoslavia had any hope to it.

There are still people out there who insist that the future of the region is some sort of federation. The problems of the area are global problems, have always been global problems and now solutions drift further and further out of the hands of those of the region.

This guy would be a political appointee who is desperate for a job since no lawyer worth their salt would take on such a position – generally it’s called scraping the bottom of the barrel or bottom feeders. I’m sure he attended the proper educational intuitions and joined the right political party back home, but with one problem. He is so bad at his chosen profession at home, the Hague tribunal is the only place left for him.
It’s much like the judiciary at the tribunal. They are inept, incompetent and would never be allowed to run a traffic court in their countries.

According to Nice:
"There is no shortcut for people like Clark, who are trying to rehabilitate Milosevic, to take a paragraph from the whole judgment, citing it incorrectly and using it out of context," said Nice.

---

It appears that Nice could be talking about sj and Ari Gold, as they express the same sentiments. (See their comments below.) As a matter of fact, from their comments, they seem to be the same person. In their vain attempt to make a point, sj and Ari have exposed themselves to be one and the same troll. Their comments couldn't be more similar!

"It is "a simple and irrefutable fact" that it was "Serbia" that committed by far the most crimes during the conflicts of the 1990's - "both by number and severity" - and that they "lead to Milosevic."

It's refreshing to finally hear someone stand up to Serbia's attempts to negate it's own behaviour in the 90s. Hats off to Nice for stating the plain truth. It's a shame this truth doesn't get repeated as much as serbia's lies in which it attempts to negate its own guilt or at least equate guilt on all sides when that doesn't work. The world needs more people like Mr. Nice.

What would you expect from a person like Geoffrey Nice other than what he has stated? The problem with people like Mr Nice is that they have no idea the difference between a proper court and a tribunal.

No one is rehabilitating Milosevic. He was a corrupt autocrat. We are just saying to hell with you, your biased, falsified court and anything that comes out of there. Serbia needs to pass a motion condemning the ICTY and the previous regimes' collaboration with this monstrous kangaroo tribunal. From the very onset, the role of the ICTY was to legalize the murder of Serbian civilians and exaggerate the role of anyone that fought for the Serbian side. Fossils like Nice helped in this project from the very beginning. His opinions should be taken with a grain of salt.

What a disgusting human being this “prosecutor” was during the trial and obviously still is. His entire case was built around a “Joint Criminal Enterprise” (basically saying that Karadzic and Milosevic conspired together to cleanse and create a “Great Serbia” – BTW this accusation was dropped against Milosevic event during trial).
The charges against Milosevic and Karadzic are linked...

He says that “Serbia by far committer the most crimes during the conflicts”…this man is obviously afraid for his career now as he was part of the propaganda machine that demonized Serbs. Serbia was cleared by the ICJ and found it was not guilty in the case Bosnia had against it. Let’s look at the facts on the ground Mr. Nice; tell me who was held accountable for the 30k dead Serbs in Bosnia, the 250k cleansed Serbs from Croatia and for the Serbs that were killed for their organs in Kosovo? Not to mention the crime of NATO bombing Serbia with no UN resolution?
What nonsense this man spews out...

Nice, the idiot, or his ICTY apologists should explain to us which crimes was "Serbia" accused, tried and convicted of? The ICTY prosecutor reveals he wasn't prosecuting individuals but stupidly admits his prejudicial bigotry of prosecuting "Serbia".

"Mr. Nice" is full of lies as I outlined below...who is "negating" Serbia's role in the 90s? The Serbs have never "negated" their role but expect others to finally admit to theirs. the time has come for the Serbs not to be referred to as the SOLE aggressor in all the Yugoslav wars in western media...that is the point...lets look at the facts cause last time i checked nearly EVERY western media outlet in the 90s ONLY blamed the serbs for the wars. Milosevic trying to create a "greater serbia" was the core and foundation of this propaganda...glad to see the truth finally coming out in the west...

Nice should simply refrain from issuing misleading political statements. Highly unethical behaviour, clear evidence of bias against the late President Milosevic and Serbs. Can somebody explain to this clown that a prosecutor should't be comparing crimes as if they were stones? Serbs threw more because we prosecuted only Serbs, Serbs therefore committed more crimes...c'mon Geoffrey, c'mon, that's an insult to common sense!

Dear, obviously not an Englishman,
What do you mean finally standing up to? What does that mean? Maybe you were too young in the 90's, but all of western media railed against Serbia, most still do.
It's just with communications today, the real truth is coming out. Western people don't believe the lies, anymore than Iraq soldiers killing babies in incubators. If you do, good for you.
There need to be more people like nice out there...lol

Milosevic was a communist who believed that some kind of Yugoslavia was the only hope for the region. He didn't understand, or wouldn't, that the SFRY was what laid the foundations of what came. He was proud to be a Serb and claimed to defend the Serbian people, but would not come to terms with what was obvious to everyone else, that nothing like the former Yugoslavia had any hope to it.

There are still people out there who insist that the future of the region is some sort of federation. The problems of the area are global problems, have always been global problems and now solutions drift further and further out of the hands of those of the region.

Milosevic should get a street name and a monument should be erected.
I suggest that it be setup in Northern Mitrovica in the province of Kosovo.
The albanians have many monuments dedicated to former war criminals and KLA terrorists.
Having a monument set up to Milosevic is a great way for both communities to heal and for the Serbs and the albanians to come together and admire all his good deeds in Kosovo.
