Croatia needs Serbian approval to drop suit

Serbian international law expert Tibor Varadi said that Serbia must give its approval in order for Croatia to drop its genocide suit.

Serbian international law expert Tibor Varadi said that Serbia must give its approval in order for Croatia to drop its genocide suit. He explained that such a solution is logical because it takes into consideration the possibility that it is “in the interest of the side being accused to proceed and get to the truth instead of agreeing to have the suit pulled.” Croatia needs Serbian approval to drop suit “With filing a countersuit, Serbia has entered the dispute,” Varadi told daily Politika, adding that “the question is whether Croatia has entered the dispute regarding the Serbian countersuit.” Varadi said that Croatia can answer the countersuit and it will be given enough time to comment on the accusations in the countersuit. “After this, the court will decide whether the future process will be united or separate. A rejection would be much more logical, because it is the same contexture of events,” Varadi said. He said that “if there is approval by both sides, and it is unimaginable for Croatia to drop the suit and Serbia not to do the same, the two sides can refrain from the suits at any time because they are the masters of the process.” “The court is not setting any deadlines in this sense. Of course, the two sides would show greater respect towards the court if they were to do it before the oral debate is scheduled. Since the political climate is a slightly more favorable now, it is expected that this will happen soon,” Varadi said. “I think that the chances now for an out-of-court settlement are greater because the newly elected Croatian president is a man of law, who knows what the chances are of Croatia to prove genocide,” Varadi said.
