The public prosecutor dismissed the indictment against General Vladimir Trifunovic and four officers of the former Yugoslav People's Army (JNA). The decision came after it was determined that the accused acted out of extreme necessity during the retreat of the army from Varazdin, Croatia, in 1991. Case dropped against former general Spokesman for the State Prosecutor's Office Tomo Zoric specified in a statement for Tanjug that the prosecution holds that “there are no elements of the criminal act of undermining military and defense capabilities” in the actions of the accused, since they acted out of extreme necessity. The indictment against Trifunovic and the others was brought by the Military Prosecution on January 30, 1992, for the criminal act of undermining military and defense capabilities. Last year, the Serbian Supreme Court overruled the judgment which sentenced Trifunovic to seven years in prison and ordered a new trial. Trifunovic was sentenced to seven years in prison in 1995, for the 1991 pullout of 250 soldiers from the Varazdin army barracks after a siege and battle with Croatian forces that lasted for several days. He saved the soldiers' lives in the process. One year into serving his sentence, Trifunovic was released from prison by a decree of president of Yugoslavia at the time, Zoran Lilic, but the verdict against him was not overturned. In the 1990s, Trifunovic was also sentenced to 15 years in prison in Croatia, for alleged war crimes during the conflict in Varazdin.
