Another verdict against the parents of the killer boy from Ribnikar
The High Court in Belgrade issued a verdict obliging the defendants Vladimir and Miljana Kecmanović, their minor son who committed mass murder, and the "Vladislav Ribnikar" school to pay the plaintiff, minor J.D., who was wounded that May 3, 2023.
According to the verdict, the defendants are obliged to pay jointly and severally in the name of non-material damages a total of 3.1 million dinars due to the physical and psychological pain suffered.
They are obliged to pay 1,500,000 dinars for the suffered mental pain due to the reduction of general life activities, 600,000 dinars for the physical pain suffered, 800,000 dinars for the fear suffered, and 200,000 dinars for the suffered mental pain due to embarrassment, it was confirmed for Tanjug in that court.
On the other hand, the court rejected the plaintiff's request for compensation for non-material damage in the remaining part, i.e. over the amounts awarded up to the requested amount, as unfounded.
The defendants are also obliged to pay the costs of the proceedings with statutory default interest.
In the explanation of the verdict, among other things, it is stated that K.K. responsible for the damage suffered by the injured boy, bearing in mind that he was capable of reasoning, while his parents are responsible for the damage caused by their minor child because the damage was caused by the bad upbringing of the minor, bad examples and vicious habits that the defendants as parents gave him.
It is added that Vladimir Kecmanović took his son to the shooting range and taught him to handle weapons, shoot at targets, although this type of activity did not correspond to the age and development of the child, and he is responsible, as the court assessed, because he kept weapons in the apartment with the children in a place that was accessible to them, i.e. because he kept weapons and ammunition in the busiest part of the apartment in the closet in the hallway.
According to the court, Miljana Kecmanović is responsible because she did not establish herself or prevent her husband from taking the child to the shooting range, where K.K. learned to handle firearms, nor did she take into account how her husband stored firearms, that is, how they were secured in the apartment where they live.
By their behavior, Vladimir and Miljana Kecmanović showed that, as parents, they did not take care of the upbringing and development of their minor son, which is why they are also responsible for the non-material damage suffered by the minor plaintiff J.D.
Also, the court considers that there is responsibility for damage on the part of the school, because the school, as an educational institution, has the obligation to provide a safe environment for students and to organize supervision over them during their stay at school, which, according to the court's opinion, was missed in this case, thus creating the responsibility of the school for the damage that K.K. caused because it is a foreseeable risk, which could have been prevented.
Appeals against this verdict are allowed to the Court of Appeal in Belgrade.
Of the five lawsuits filed by family members of those killed and wounded, three have been completed.
According to the lawsuit filed by 27 members of the families of those killed, the Kecmanovics and the school are obliged to pay them about 350 million dinars, while the Kecmanovics are obliged to pay the injured history teacher almost seven million dinars.
According to the first-instance verdict of the Higher Court in Belgrade, Vladimir Kecmanović was sentenced to a single prison sentence of 14 and a half years for the criminal acts of neglecting and abusing a minor and a serious crime against general security.
His wife Miljana Kecmanović was sentenced to three years in prison for the crime of neglect and abuse of a minor, while shooting instructor Nemanja Marinković was sentenced to 15 months in prison for giving a false statement.
The boy K.K., who at the time of this crime was not yet 14 years old and therefore not criminally responsible, shot his friends with two of his father's pistols that he took on May 1.
Then on the fateful day, he put them in his backpack, went to school and during the first lesson killed 10 people and injured five more children and a history teacher.
