The die was cast: Ursula "had fallen"!
The Supreme Court of the EU overturned the European Commission's decision to deny the New York Times access to messages exchanged between President Ursula von der Leyen and Pfizer CEO Albert Bourla, reports Euronews.rs.
After a long tussle between the EC and the New York newspaper over transparency related to Pfizer's Covid-19 vaccine contracts, the European Court of Justice (ECJ) ruled today that the Commission "did not provide a convincing explanation to justify not having the requested documents".
According to the court, the Commission cannot simply claim that it does not have the requested documents; it must provide plausible explanations that enable both the public and the Court to understand why those documents cannot be found.
The ECJ found that the New York Times submitted relevant and consistent evidence indicating the existence of text messages between the President of the Commission and the CEO of Pfizer regarding the procurement of vaccines against Covid-19.
"These contracts were completely unprecedented," an EU official said before the ruling.
The paper discovered the existence of the 2021 messages during an interview with Bourla, but ran into obstacles when requesting access to them.
The European Commission claimed it could not provide the texts.
After multiple unsuccessful attempts to obtain the messages, the New York Times initiated proceedings before the European Court of Justice in January 2023.
The Court has now found that the Commission did not adequately clarify whether the requested text messages were deleted and, if so, whether the deletion occurred intentionally or automatically.
