Prosecution proves that KLA members committed crimes

Judge Smith also read out that the Panel had concluded that the Prosecution had proven that KLA members intentionally committed acts and omissions that caused the deaths of at least 98 people, constituting the war crime of murder.

The judge also read portions of the indictment concerning the mistreatment of detainees, who were brutally beaten with rifle butts, electrical cables, sticks and other objects.

Some were forced to beat one another, while others were beaten to death. Some were hung upside down while being beaten.

It was also recorded that one detainee, as a result of the physical abuse, asked for a bullet to be used to kill him. KLA members told him that there was no bullet for him and that he would die slowly.

The Prosecution also stated that the abuse included forcing detainees to listen to the torture of other prisoners. Particularly brutal treatment was recorded in the torture of one detainee, which lasted for hours and caused the other prisoners to cry.

The testimony of one witness was also cited, who said that KLA members deliberately left one detainee who had killed himself so that the others would be forced to watch.

It was stated that the detainees were not provided with food or medical assistance and were not allowed to bathe. They were forced to relieve themselves on the floor. They were restrained with chains and handcuffs, and their hands and feet were often bound.

The judge read portions of the indictment describing particularly brutal treatment of detainees, who were neither put on trial nor given an opportunity to challenge the lawfulness of their detention.

They were left at the mercy of their captors, deliberately arrested, not informed of the reasons for their detention, and denied the opportunity to defend themselves. The Prosecution concluded that it had been unequivocally proven that the crime of unlawful deprivation of liberty had been committed against at least 385 people.
