You pose some valid questions , to answer one of them, yes there is a country that pursues judiciary processes in another sovereign country and that is the United States of America, Guantanamo Bay comes to mind.

Notwithstanding the complete disintegration on international law, if Serbia is intent in joining the EU , it must abide by all of the institution rulings including the rule of law. Any country joining the EU is essentially giving up a good part if it's legal, political and economic sovereignty. It seems to me Croatia will not do so well, it was not comfortable in an Austro-Hungarian or Yugoslav federation , what makes you think it will flourish in a much larger EU federation . As for Serbia, the EU is a lose lose situation , far better off not joining. Croatia did make one correct move by controlling it's monetary policy by keeping the Kuna.

Banovic: The issue is not whether Croatia has a valid case in arguing as they are, it is whether they should be using their veto to get their own way. I would hope that if the Croatian case is as strong and straightforward as you make it sound it will be taken up by EU colleagues. If it is not, then the process should move on.

I am biased (Croatian), but isn't withdrawing judicial authority for prosecuting war crimes over the entire former Yugoslavia a valid requirement? With exception to global institutions like the UN, is there another country in the world that prosecutes crimes committed on another sovereign nations territory? If the situation were reversed, wouldn't Serbia require the same thing? This is not Croatia blocking Serbia over a border dispute like the case with Slovenia.

Matija: In an ideal world you are right of course, but that is not where we are. Only Slovenia stood in Croatia's way when all the other countries were happy; why? because they could. The EU will have to allow Serbia, Bosnia and Albania to join together or the latter two will never get past Serbia's veto. I can envisage a situation where the RS President in Bosnia (probably not Dodik by the time that Bosnia is ready to join) asks Belgrade to insist on independence for the entity as a condition of not using the veto. The veto is supposed to be used in extremis not as a form of revenge or blackmail. I can't think of any legitimate reason for Croatia blocking Serbia other than an attempt to arrange history to fit their own version of events. They have been up in arms over the Seselj verdict and an unsuccessful appeal by the prosecution will only harden their attitude against Serbian membership.

Serbia has a lot of work to do to make the Serbian people safe and prosperous. All this since the collapse of the SFRY. Whatever the future of the EU is, Serbia has to make changes and adapt new strategies to sustain itself and these coincidentally correspond to many of the demands made by the EU for membership.

One of the things that your enemies will do is convince you that the changes you make in your life are somehow a submission to them, even though you would be making them if these enemies did not exist. Meanwhile, it is also good to conduct yourself as if your enemies were not who they clearly are. React to behavior, not personalities. Keep careful accounts and keep your guard up.

This is how Serbia is proceeding. Russia is a friend, but you should never lean too heavily on friends. The Croatians are enemies, but they are a very small enemy representing a larger one.

I have long commented on these pages that those joining the EU from 2004 onwards should not have a veto as it was crystal clear what would happen between Slovenia and Croatia and now between Croatia and Serbia. No doubt if Serbia were to join it would in turn try to exact its pound of flesh from Montenegro and Bosnia. The EU does not seem to understand the animosity that exists between Balkan countries and tries to use 'soft power' to persuade everyone to be one big happy family. They need to wise up quickly or abandon further Western Balkan expansion.

Matija: In an ideal world you are right of course, but that is not where we are. Only Slovenia stood in Croatia's way when all the other countries were happy; why? because they could. The EU will have to allow Serbia, Bosnia and Albania to join together or the latter two will never get past Serbia's veto. I can envisage a situation where the RS President in Bosnia (probably not Dodik by the time that Bosnia is ready to join) asks Belgrade to insist on independence for the entity as a condition of not using the veto. The veto is supposed to be used in extremis not as a form of revenge or blackmail. I can't think of any legitimate reason for Croatia blocking Serbia other than an attempt to arrange history to fit their own version of events. They have been up in arms over the Seselj verdict and an unsuccessful appeal by the prosecution will only harden their attitude against Serbian membership.

You pose some valid questions , to answer one of them, yes there is a country that pursues judiciary processes in another sovereign country and that is the United States of America, Guantanamo Bay comes to mind.

Notwithstanding the complete disintegration on international law, if Serbia is intent in joining the EU , it must abide by all of the institution rulings including the rule of law. Any country joining the EU is essentially giving up a good part if it's legal, political and economic sovereignty. It seems to me Croatia will not do so well, it was not comfortable in an Austro-Hungarian or Yugoslav federation , what makes you think it will flourish in a much larger EU federation . As for Serbia, the EU is a lose lose situation , far better off not joining. Croatia did make one correct move by controlling it's monetary policy by keeping the Kuna.

I am biased (Croatian), but isn't withdrawing judicial authority for prosecuting war crimes over the entire former Yugoslavia a valid requirement? With exception to global institutions like the UN, is there another country in the world that prosecutes crimes committed on another sovereign nations territory? If the situation were reversed, wouldn't Serbia require the same thing? This is not Croatia blocking Serbia over a border dispute like the case with Slovenia.

Banovic: The issue is not whether Croatia has a valid case in arguing as they are, it is whether they should be using their veto to get their own way. I would hope that if the Croatian case is as strong and straightforward as you make it sound it will be taken up by EU colleagues. If it is not, then the process should move on.

Croatia is not a nation, it is an anti-nation. It exists only to oppose Serbia. It is like Pakistan (anti-India) and the Ukraine (anti-Russia). These artificial nations have no positive role to play, they are just spoilers. Croats have no pride in Croatia as such, they are merely pleased that they are “not Serbs.” Croats would prefer to be Austrians or Germans. But since the good Lord didn’t bless them with Aryan blood, they have to be content with their miserable existence because at least they are not Serbs.

Serbia is a nation. Its people have pride in their history and culture. They know their history is not as glorious as other nations or their culture as rich as the French, Italians or Russians, but they are proud nevertheless. Serbs have withstood barbaric invasions from the Latin Crusaders, the Turks, Austrians, NAZIS, and NATO. They have their own art, language and literature, and they still have their own Church.

Croats have none of this. Their Church is a foreign imposition, their native Croat language has been replaced by Serbian, and culture (authentic folk culture) is neglected by the western-focused Croats.

Croats will continue to oppose Serbian entry into the EU, just as they will oppose Serbia in the Eurovision song contest, and in football and in everything else. That is their job. That is the reason for their existence.

Croatia should block Serbia indefinitely and Serbia should simply give up this idea of joining a failing union. The UK and other other members are looking to exit. The Dutch, in a referendum, have just rejected a partnership between the EU and Ukraine. Iceland withdrew from joining the EU.

I have long commented on these pages that those joining the EU from 2004 onwards should not have a veto as it was crystal clear what would happen between Slovenia and Croatia and now between Croatia and Serbia. No doubt if Serbia were to join it would in turn try to exact its pound of flesh from Montenegro and Bosnia. Serbia has a lot of work to do to make the Serbian people safe and prosperous. All this since the collapse of the SFRY. Whatever the future of the EU is, Serbia has to make changes and adapt new strategies to sustain itself and these coincidentally correspond to many of the demands made by the EU for membership.

One of the things that your enemies will do is convince you that the changes you make in your life are somehow a submission to them, even though you would be making them if these enemies did not exist. Meanwhile, it is also good to conduct yourself as if your enemies were not who they clearly are. React to behavior, not personalities. Keep careful accounts and keep your guard up.

This is how Serbia is proceeding. Russia is a friend, but you should never lean too heavily on friends. The Croatians are enemies, but they are a very small enemy representing a larger one.
