1. a first hand witness provided the sworn testimony.
2 this was not second hand testimony, but testimony by an individual who was intimidated and bribed by the ICTY.
3. This was a witness originally called for the prosecution; NOT a defence witness.
4. The OTP must have standards for its own witnesses and therfore it is reasonable to assume this evidence to be credible.
5. Is icj1's argument that OTP witnesses are not credible?
4. In most reputable jurisdiciaries "proof beyond reasonable doubt" is required for CONVICTION. Why is proof beyond reasonable doubt required for investigation or a prima faceia case at the ICTY?
5. What are the different legal Burdens of Proof at the ICTY? Are some investigations and indictments based on simple allegations whereas others require proof beyond reasonable doubt?

For the same reason that Serbia didn't attack the KLA camps that everyone knew about in Albania. It would be fighting against a sovereign country and nobody would let that happen. If you somehow get another Millishevic now and decide to go against Kosovo, you would be going against a sovereign country and Albania would be the first in.

As far as fighting goes, nobody in the Balkans can match up to Albanian warriors. The average Serb would pee their pants in front of an average Albanian. The only way your coward nation can fight is when you have a whole army and air force fighting against unarmed civilians.

Dude, if you had read the ICTY transcript from 6 July 2010, you would have realized that Amnesty Yugoslavia did not testify or say anything. The court transcript has the testimony of the prosecution's witness, namely one Nenad Jovic. In terms of individual economic freedom we again rank much higher than you, Albania 59th, Serbia 77th. The Sebian government has been offering to hear all the evidence regarding ICTYs criminal threats, intiminidation and blackmails of Nenad Jovic for more than a year. The latest protest was in specific response to the ICTY's Feb 10th 2016 public statement. Sure... but "available" and "credible" is not the same thing (in the normal English, at least - not sure what in the English taught to you). When you show that the evidence you are referring to was determined to be credible beyond reasonable doubt, you may have a point, but until then you have not shown anything that has implicated ICTY in perpetrating a crime beyond reasonable doubt. So far, the evidence of the crime that ICTY has allegedly perpetrated is because a certain Amnesty Yugoslavia said so!

Serbia offered to review ALL the evidence and provide the judicial determination. Since the evidence directly implicate crimes by the ICTY versus allegations by the ICTY the crimes were committed by defense counsel, an unbiased evaluation of evidence could only be conducted by an appropriate third party. Yes, there is absolutely no proof to substantiate the allegations by the ICTY that defense counsel intimidated anyone. In fact, the evidence indicates that the ICTY actually committed the crimes. The facts in the ICTY's own records support a prima faceia case AGAINST the ICTY.

A Banana Court who's time has come and gone.

Serbia is far enough down the path of european re-integration where this banana court can do nothing to it.

The only thing Serbia needs to do is:

1. Continue to liberalise and grow its economy so that it becomes one of the engines of economic growth in a region which lacks enough of them, while also providing a sizeable market for western companies to growtheir balance sheets.

2. Help the EU ease the migrant situation in a humanitarian way

3. Vigilantly fight the democratic battle against global Islamic terrorism

4. Continue to normalise relations with K

if they do these things, no one cares what the Banana Court has to say.

It has already acheived its political objective.

I as a reader am urging B92, to post some more articles on the war crimes committed by other countries against Serbia, and the subsequent trials against individuals of those crimes.

Otherwise, apparently Serbs were the only ones committing these crimes and as such we have to bare the full brunt of critics.

Its awfully dignified of the Kalbs to comment now, but in a few months time when there own MP' are being sentenced,what will be said?

A Banana Court who's time has come and gone.

Serbia is far enough down the path of european re-integration where this banana court can do nothing to it.

The only thing Serbia needs to do is:

1. Continue to liberalise and grow its economy so that it becomes one of the engines of economic growth in a region which lacks enough of them, while also providing a sizeable market for western companies to growtheir balance sheets.

2. Help the EU ease the migrant situation in a humanitarian way

3. Vigilantly fight the democratic battle against global Islamic terrorism

4. Continue to normalise relations with K

Nobody said that these three gentlemen who intimidated, bribed and influenced witnesses in the case against Seslj committed any war crimes. But it seems Serbia prefers to protect those people, and failed to extradite them for more than a year.

I as a reader am urging B92, to post some more articles on the war crimes committed by other countries against Serbia, and the subsequent trials against individuals of those crimes.

Otherwise, apparently Serbs were the only ones committing these crimes and as such we have to bare the full brunt of critics.

Its awfully dignified of the Kalbs to comment now, but in a few months time when there own MP' are being sentenced,what will be said?

oh dear me....banana court...it holds a lot of sway however. it has imprisoned those it has convicted. it is a court that Serbia will still have to comply with. so whilst you think you have some sort of moral victory here, the court will carry on with its proceedings and Serbia has little choice but to get along with it.

The only thing Serbia needs to do is:

Sure... but "available" and "credible" is not the same thing (in the normal English, at least - not sure what in the English taught to you). When you show that the evidence you are referring to was determined to be credible beyond reasonable doubt, you may have a point, but until then you have not shown anything that has implicated ICTY in perpetrating a crime beyond reasonable doubt. So far, the evidence of the crime that ICTY has allegedly perpetrated is because a certain Amnesty Yugoslavia said so!

Our literacy rate is about 98%, same as yours. We rank 159th in unemployment, you rank behind us at 166th. We rank 60th in life expectancy, you rank way behind 102nd! In terms of individual economic freedom we again rank much higher than you, Albania 59th, Serbia 77th. I don't know what lies you've been reading, but in reality Serbia is no better than Albania, you are just another poor and backwards Balkan country.

So, keep dreaming Ivan, the only lands that will be retaken are Presheva, Sanxhak and Nish. You have been sucking Albanian blood for too long, but the tables have turned again and you will once more return to serving your Albanian masters.

The Hague was never there to make you happy.

It was there to give consequences to criminals, and messages to people like you.

You won't get an apology. You will be expected to conform.

You won't get any sympathy. It was inappropriate Serb nationalism destroyed that.

It's a court - you will have to respect that or lose a lot more.

If you feel humilitated, that is more a statement about your psychology.

Please educate yourself and learn that Serbia offered to conduct a hearing and judge those responsible for this witness' intimidation more than one year ago. Witness Jovic provided evidence that the OTP perpetrated this crime and ICTY's absurd response was an infantile and baseless counter claim against the defense team.

Serbia offered to review ALL the evidence and provide the judicial determination. Since the evidence directly implicate crimes by the ICTY versus allegations by the ICTY the crimes were committed by defense counsel, an unbiased evaluation of evidence could only be conducted by an appropriate third party. Yes, we understand you and other ICTY apologists only recognize biased judges.

Yes, there is absolutely no proof to substantiate the allegations by the ICTY that defense counsel intimidated anyone. In fact, the evidence indicates that the ICTY actually committed the crimes. The facts in the ICTY's own records support a prima faceia case AGAINST the ICTY.

The court transcript has the testimony of the prosecution's witness, namely one Nenad Jovic. The Sebian government has been offering to hear all the evidence regarding ICTYs criminal threats, intiminidation and blackmails of Nenad Jovic for more than a year. The latest protest was in specific response to the ICTY's Feb 10th 2016 public statement. I agree with you: the crimes of the ICTY which the intimidated witness exposed during the Seselj trial should have prosecuted in a more timely and vigorous manner.

Considerations for the "ignorant":

1. a first hand witness provided the sworn testimony.
2 this was not second hand testimony, but testimony by an individual who was intimidated and bribed by the ICTY.
3. This was a witness originally called for the prosecution; NOT a defence witness.
4. The OTP must have standards for its own witnesses and therfore it is reasonable to assume this evidence to be credible.
5. Is icj1's argument that OTP witnesses are not credible?
4. In most reputable jurisdiciaries "proof beyond reasonable doubt" is required for CONVICTION. Why is proof beyond reasonable doubt required for investigation or a prima faceia case at the ICTY?
5. What are the different legal Burdens of Proof at the ICTY? Are some investigations and indictments based on simple allegations whereas others require proof beyond reasonable doubt?
7. Are different standards of evidence used for different people and ethnicities at the ICTY? Are some investigations and indictments initiated on grounds of "reasonable suspicion" whereas others, such OTP crimes, require "beyond readonable doubt"?
5. Should the same laws and principles apply equally to all? Why is icj1 demanding "proof beyond reasonable doubt" to initiate a prima faceia case?

Proof beyond reasonable doubt that OTP corruption and cover-up are systemic ICTY crimes is indeed substantiated by Nenad Jovic's testimony. These facts are plainly evident on 11 pages of the 6 July 2010 testimony. Pages 16161 to pages 16172, inclusively, provide no doubt whatsoever, about systemic corruption and cover-up by the OTP and the ICTY. icj1 and other blind ICTY apologists are willfully ignorant to these undeniable facts.
