The judge, who was found to be incapable of rendering a fair decision, was responsible for the delay. The judge has personal responsibility for his own removal and no one else.
By your logic, the person reporting a crime is the criminal.

Presented with evidence of bias by a Judge, any competent first year law student would do the same. The accused was incarcerated without any power and can not force, or more precisely "Order" the court to do anything. The "Order" for disqualification came from the the acting President Judge of the tribunal, following a decision by a separate panel. The assignment of a replacement judge, was also a court decision and not "forced" by the accused; according to the rules of the ITCY circus manual, the court should have re-tried the case, just as any other reputable jurisdiction would have recognized this textbook mistrial. Arguments that supported trial continuation following the proof of bias, unfortunately favor conviction rather than justice.

The aim of a criminal trial is justice; conviction and acquittal are by-products. The ICTY's actions have not served justice and were biased against the defendant. You blaming the defendant for these serious court transgressions, speaks volumes about your notion of justice.

The verdict must be based on written reasoning. The writings of the ICTY have been laughable. Former employees, such as Florence Hartmann have openly called the ICTY a circus. According to ICTY's own judge (Harhoff) the court is corrupt and verdicts are not based on evidence, but are guided by external political powers.

You may be right, my opinion may be nothing. However, the verdicts and opinions of an institution that has been plagued by corruption and mocked by internal whistle-blowers, may not have more validity.

The trial ended more than 1100 days ago. The accused didn't delay the deliberations. The accused accelerated the trial immensely by declining to present a defense case. Yes, by the logic of ICTY apologists this a delaying tactic in their up-is-down and down-is-up-world, but most unbiased opinions agree that Seselj's refusal to present a defense case accelerated the trial by many years.

Heinous creature is your opinion and the often-changed ICTY indictment is a quasi-stable opinion of the prosecution. Both remain unproven. In fact, a judgement from a court is also an opinion of the judges. For example, Judge Antonetti has already provided his opinion to acquit Seselj of a number of charges in the May 4, 2011 Rule 98bis decision. Remarkably, the majority decision, was based on an opinion from a judge (Harhoff) that was subsequently fired for bias, and the validity of the rule98 bis decision in the Seselj case remains questionable. Notably, the ICTY removed the rule98 bis decision from the selected documents of the Seselj case on the ICTY web site, but I do encourage you to contact them and read all before forming your opinion.

The same for this scum Sheshel, he should be executed ,but since we live in democratic countries and don't have death punishment he should go back to jail until he dies.

Thank you for your touching and thoughtful post. Please do inform us: was heinous creature recently added to the changing indictment by the ICTY? I have followed this trial with great detail and not only has the ICTY circus shown itself incapable of investigating or producing evidence to support the series of modified indictments, it has shown absolute contempt for justice by taking more than 1100 days to NOT deliver a verdict after closing arguments. If, as you suggest, heinous creature has been added to the list of continually evolving accusations, I'm sure that the investigative brain-trust in the OTP will drum up a panel of experts, such as Andreas Ridlemayer to testify and who in cross examination by the defense and the judge will embarrassingly crumble to pieces.

I have spent my whole life in Australia. Made a home for myself and my family and you expect me to uproot everything to move anywhere for some time just so I can have a better view of what it's like there?

Of course he refuses to go back, he knows it is the end of the road, he knows his guilt and its time to pay the piper.
But he will resist and force Serbia and its leaders into a dilemma, send him back by force or lose the EU future.
There is no win for Serbia here, send him back and face the backwash of the ultranationalists and probably end the political stronghold of the SNS, let him stay and lose out on every chance for a future and then watch him rip the country apart.

The three judges that wrote the opinion provide no substantive argument that justifies overruling the trial chamber; the trio do not explain how the trial chamber erred and fail to demonstrate that conditions were violated, when NO CONDITIONS were ever presented to the accused.

The dissenting opinions by two judges, provide a few sprinkles of cogent thought, but they also miss many important points. Despite many omissions in the dissenting opinion, I do agree with some select wording: paragraph 19 states that the Appeals Chamber order is not supported by law or logic. Law and Logic are not common tools employed by ICTY.

The trial ended more than 1100 days ago. The accused didn't delay the deliberations. The accused accelerated the trial immensely by declining to present a defense case. Yes, by the logic of ICTY apologists this a delaying tactic in their up-is-down and down-is-up-world, but most unbiased opinions agree that Seselj's refusal to present a defense case accelerated the trial by many years.

The verdict must be based on written reasoning. The writings of the ICTY have been laughable. Former employees, such as Florence Hartmann have openly called the ICTY a circus. According to ICTY's own judge (Harhoff) the court is corrupt and verdicts are not based on evidence, but are guided by external political powers.

You may be right, my opinion may be nothing. However, the verdicts and opinions of an institution that has been plagued by corruption and mocked by internal whistle-blowers, may not have more validity.

I have followed this trial with great detail and not only has the ICTY circus shown itself incapable of investigating or producing evidence to support the series of modified indictments, it has shown absolute contempt for justice by taking more than 1100 days to NOT deliver a verdict after closing arguments. If, as you suggest, heinous creature has been added to the list of continually evolving accusations, I'm sure that the investigative brain-trust in the OTP will drum up a panel of experts, such as Andreas Ridlemayer to testify and who in cross examination by the defense and the judge will embarrassingly crumble to pieces.

Heinous creature is your opinion and the often-changed ICTY indictment is a quasi-stable opinion of the prosecution. Both remain unproven. In fact, a judgement from a court is also an opinion of the judges. For example, Judge Antonetti has already provided his opinion to acquit Seselj of a number of charges in the May 4, 2011 Rule 98bis decision. Remarkably, the majority decision, was based on an opinion from a judge (Harhoff) that was subsequently fired for bias, and the validity of the rule98 bis decision in the Seselj case remains questionable. Notably, the ICTY removed the rule98 bis decision from the selected documents of the Seselj case on the ICTY web site, but I do encourage you to contact them and read all before forming your opinion.

Presented with evidence of bias by a Judge, any competent first year law student would do the same. The accused was incarcerated without any power and can not force, or more precisely "Order" the court to do anything. The "Order" for disqualification came from the the acting President Judge of the tribunal, following a decision by a separate panel. The assignment of a replacement judge, was also a court decision and not "forced" by the accused; according to the rules of the ITCY circus manual, the court should have re-tried the case, just as any other reputable jurisdiction would have recognized this textbook mistrial. Arguments that supported trial continuation following the proof of bias, unfortunately favor conviction rather than justice.

The aim of a criminal trial is justice; conviction and acquittal are by-products. The ICTY's actions have not served justice and were biased against the defendant. You blaming the defendant for these serious court transgressions, speaks volumes about your notion of justice.

Dr Seselj has been found guilty of nothing and yet has been NATO's Political Prisoner for 12 Years. He seems to be lasting longer than they though when they released him for cancer treatment.

A FINAL verdict was promised by end June 2015, but NATO is backtracking on that. They will never issue a verdict because it will expose the Hague Tribunal as 1000% corrupt. No evidence has been presented against Dr Seselj so he can't be found guilty. Equally if he is found innocent, then it exposes NATO lies going back to 1990. Hence no verdict can be given and Dr Seselj must die in his cell, either of cancer or old age.

The appeals chamber decision, published this morning, is a laughable comedy. The three judges that wrote the opinion provide no substantive argument that justifies overruling the trial chamber; the trio do not explain how the trial chamber erred and fail to demonstrate that conditions were violated, when NO CONDITIONS were ever presented to the accused.

The dissenting opinions by two judges, provide a few sprinkles of cogent thought, but they also miss many important points. Despite many omissions in the dissenting opinion, I do agree with some select wording: paragraph 19 states that the Appeals Chamber order is not supported by law or logic. Law and Logic are not common tools employed by ICTY.

you seem to have missed the target, if in fact you feel in justice over nationalism. your point could be fair if you generalized it and didn't include a subtle nationalistic bent to it. your claim is that only those who died at the hands of this heinous creature ("this heinous creature" I repeat) excludes the same sentiment for those who died at the hands of other heinous creatures.
does not every single civilian of the former yugoslavia deserve the same?

Heinous creature is your opinion and the often-changed ICTY indictment is a quasi-stable opinion of the prosecution. Both remain unproven. In fact, a judgement from a court is also an opinion of the judges. For example, Judge Antonetti has already provided his opinion to acquit Seselj of a number of charges in the May 4, 2011 Rule 98bis decision. Remarkably, the majority decision, was based on an opinion from a judge (Harhoff) that was subsequently fired for bias, and the validity of the rule98 bis decision in the Seselj case remains questionable. Notably, the ICTY removed the rule98 bis decision from the selected documents of the Seselj case on the ICTY web site, but I do encourage you to contact them and read all before forming your opinion.

The trial ended more than 1100 days ago. The accused didn't delay the deliberations. The accused accelerated the trial immensely by declining to present a defense case. Yes, by the logic of ICTY apologists this a delaying tactic in their up-is-down and down-is-up-world, but most unbiased opinions agree that Seselj's refusal to present a defense case accelerated the trial by many years.

Excuse me was it not Seselj who petitioned the court to have the judge removed from the case after its conclusions and thus forcing the court to appoint a new judge who had to review years of testimony in order to render a decision??? I would say he is directly responsible for the delay.
He has deliberately delayed the proceedings from day one. To say otherwise is to only show how foolish one can be.

Sorry, but rereading my post, no where do I get that any SANE person would interpret that I was claiming that being a Heinous Creature was part of the indictment. It was merely my opinion of him, just like your characterization of the ICTY is your opinion, it means nothing, it will not affect the verdict once rendered. It will not change Seselj's future. It will only provide a subject for you and your ultranationalist friends to toss back and forth at the local bar.

The verdict must be based on written reasoning. The writings of the ICTY have been laughable. Former employees, such as Florence Hartmann have openly called the ICTY a circus. According to ICTY's own judge (Harhoff) the court is corrupt and verdicts are not based on evidence, but are guided by external political powers.

You may be right, my opinion may be nothing. However, the verdicts and opinions of an institution that has been plagued by corruption and mocked by internal whistle-blowers, may not have more validity.

The judge, who was found to be incapable of rendering a fair decision, was responsible for the delay. The judge has personal responsibility for his own removal and no one else.
By your logic, the person reporting a crime is the criminal.
That is foolish.
