"Genocide bar raised very high" - outgoing Croat president

With all due respect to someone who deserves respect for being one of the few leaders in the Balkans to rise above the nationalist fray (when he's not forced to toe the official line of Croatia), the bar was already pretty high in regards to what qualifies as genocide and what doesn't. Croatia's attempt to prove genocide took place in Vukovar was an attempt to not only lower it significantly, but open the door for dozens of other crimes against humanity that could now be labeled as genocide; something that should not be used as a political tick mark.

What's worse is that the rationale for the ruling today even places the acknowledged genocide of Srebrenica in doubt - not that there will be a reversal of judgement there, but the nature of the mass killings doesn't add up to the policy of premeditated destruction of a people.

Though I tend to disagree more with Ian than agree around here, I have to echo what he posted earlier about the numbers of those dead being far too small to qualify. Ethnic cleansing, yes. War crimes, very likely. Genocide, no.

Actually no - i live in Australia - I love it here and am a proud Aussie. I am not nor have i ever been a Serb.

Although I agree with most of what you say BA, I must remind you here that Josipovic is a lawyer by education and defended Gojko Susak who was brought up on war crimes charges at the Hague following the war of the 90s. Susak died while in custody. During the war he was Tudjman's Secretary of Defense and was instrumental in the short-lived dream of Herceg Bosna, aka Greater Croatia. Originally from western Hercegovina, Susak emigrated to Canada and made money in the pizza business. Returning to Croatia during the war, he was one of Tudjman's closest allies in bringing back the Ustasha ideology.

So you can see even the ostensibly more moderate politicians of Croatia like Josipovic even have fascist leanings.

Here are the simple facts: Croats and Bosniaks broke the Yugoslav constitution and international law by prematurely seceding. They got away with this because the US, Germany and the UK backed them. They armed themselves, primarily the Croats, to the teeth prior to this knowing there would be war. They wanted war, they got war. All sides lost terribly. Regarding Bosnia, Serbs now control 49% of the territory with only 31% of the population. Their territory grew significantly from what it was before the war with essentially the same Serb population. But, that is the point. The ICTY is a 'ad hoc' tribunal. The ICC is permanent, so if it followed ICTY 'standards and procedures' a lot of european countries would be judges likewise, from a very low bar. That simply wouldn't be cricket!

Excuse me. Yugoslavia was created in 1918 and the Croats begged to get in after getting pounded in WWI. Serbs naively took them in. If the Serbs wanted to create a greater Serbia, why didn't they name the country Serbia instead of Kingdom of the Serbs, Croats & Slovenes. After all, the Serbs won the war. Your comment is absurd.

No one won or lost in those wars especially not insignificant nobodies like people posting on these forums. Go back to your little life and just move on. Get over your ethnicity as it means nothing. And get over trying to prove a point to people on here. Yugoslavia break up was a tragedy. A tragedy that greatly benefited the west and criminal elements from the Balkans. It's 2015, it's the future, and it's time to move the f@&k on!

sorry njegos, you could say that you won in bosnia all you want, but here are the facts, you occupied parts of bosnia under communist yugoslavia, you held 70% at the beginning of the war, mostly because you got the west to put an arms embargo on the bosniaks while serbs had the yugoslav army, your aim was to create a greater serbia that has a large adriatic coast, you killed a bunch of civilins many of which were wrongly classified as soldiers, got the croat leader to betray the bosniaks to divide bosnia, ended up being pushed back anyway, getting the international community to stop the war, losing more soldiers to the bosniaks then to slovenes croats albanians and NATO put together, not having greater serbia, living in a genocidal entity that is run by a wannabe dictator, and going to vanish one way or another. If that is a victory to you then there is no hope for you as a people.

Poor chap! If only it had been the International Comedy Tribunal for the Former Yugoslavia in the Hague that had made the ruling. It has much, much, much lower standards.

But, that is the point. The ICTY is a 'ad hoc' tribunal. The ICC is permanent, so if it followed ICTY 'standards and procedures' a lot of european countries would be judges likewise, from a very low bar. That simply wouldn't be cricket!

For starters, most of the west would be in court for what they did to Libya if that were the case.
