the court judges have to be approved by EULEX and hence the EU so don't talk out of your a**
(Nikolle, 1 July 2012 13:39)

EULEX approved? Sorry, knowing how things work (or not) in Kosovo I cannot consider this as a qualification...

well, what do you know, perhaps the EU is the one corrupting Kosova eh? they have supreme authority, even over Kosovar elected officials

This is the biggest pile of crap ever. Mr Mar has continuously refused to give any evidence. It gives more fodder to those who say his report is just fiction.

oh and comm. are you aware that EULEX investigators and hence the EU also ruled Hasanaj's death suicide (though it is a very off form of suicide i'll grant you that)

Only normal that a CoE rapporteur has the right to refuse to testify to protect the witnesses. Just like journalists and similar people.

Especially in a court of mafia state like Kosovo where you cannot trust even judges and police officers because they could have connections to local war lords or mafia gangs or former KLA mates.

"For the moment, they are mostly committing suicides," a source said of the witnesses, adding that "after everything that's happened, Kosovo doesn't even have a law on witness protection".

The famous Kosovarian 'suicides' like stabbing yourself 12 times. Not to forget the 'car accidents', or other kinds of 'natural death' which are happening to witnesses in this mafia state.

Marty has painted himself into a corner. He realizes if he reveals the names of "witnesses" and/or "victims", he will be exposed as a slanderer and be subject to a libel suit and may end up spending many years in prison. The few pieces of silver received from Serbia now seem hardly worth the harsh consequences.

"Article 14 of the PACE General Agreement on Privileges and Immunities of the Council of Europe, which stipulates the parliamentary immunity as absolute, permanent and unrestricted and that the Parliamentary Assembly cannot abolish it. "

Without doubt this is one of the best jobs in the world. I wish I was a CoE organ trade rapporteur.

They keep up his imunity because the OSCE knows that both EUlex and Pristina are not to be trusted and they don't want to endanger witnesses.

Poor Marty , his truth or lie( till he don't testify we don't know) will be buried in his grave... I hope he is a good writer, so his report can be printed as Yellow Book.

Is it truth and justice or truth or justice

If they are upholding his immunity then it means he can testify without the concern of any criminal liability, not the other way around.
As far as friction between the CoE and EULEX, if I tell you I have evidence of a crime and you are to investigate it, and then I say I am not going to give you my evidence or the sources of my evidence. I think there might be some friction between you and me.
But I think the most friction is between Marty and the CoE because he will not give them any of the evidence either and they are the ones who gave him his mandate.
But I guarantee anything he knows or claims to know substantiated or not is already in book form awaiting a time for publishing. The same as Carla but maybe he has learned from her errors.
Any Serbs that are truly after the truth should be the ones up in arms wanting him to be forced to reveal the truth, those that just want to keep it alive are satisfied with someone standing up and saying "I" have proof it happened but I cannot divulge it.

To this day NOT AN OUNCE of evidence has been provided and yet b92 expects us to fully be engaged in this witch hunt? The only "evidence" was destroyed by the witch (carla del ponte) years ago to this supposed scandal.

Sincerely,

What exactly does all this BS mean? I have read this story twice, and I have no idea what is being reported here. Is Eulex trying to forbid Marty from doing something, are they in conflict with the COE? What the hell is going on? I was afraid that some legal mumbo jumbo would impede this investigation, and I think what I am reading is that the West is protecting their clients in Pristina and Tirana. Makes sense, what would the USA and the EU look like, if they backed organ harvesters? It's a truly sad world we live in, when monstrous crimes as the ones the KLA, Thaci, and Albania are suspected of, and it may never come to trial. I am saddened by this news, and appalled at Western leaders, and their convenient form of justice.
