"Referendum on Kosovo and EU would be unconstitutional"

Opposition DSS party leader Vojislav Košunica says any referendum "choosing between the EU and Kosovo" would be unconstitutional, illegitimate and illegal.

A Constitution that places Kosovo on its preamble, BUT 1.2 million eligible voters in Kosovo did not have the right to vote on it in the referendum in 2006.

Only 51.46% of the 6.6 million eligible voters of Serbia (excluding Kosovo) approved it. If they included the 1.2 million of Kosovo's eligible voters on this count, the approval would only be at 43.54%, thus making this constitution illegal.

... but I doubt that anyone cares about Kosovo more than people that currently live in Kosovo.

Therefore, as a Kosovo resident I advise you to take it easy with your pseudo-patriotism. Do something constructive and stop wasting valuable years of your life wishing for something that will never be - that is, any chance that Serbia will ever re-integrate Kosovo into Serbia.

P.S. That's not where it all started. It started in Rascia (Raška), which is north of Kosovo. Or perhaps should we go to way back to Serbian medieval migrations from the Proto-Slav areas, or North Caucasus and Lower Volga?

Let me guess, you and Ceda Jovanovic, Natasa Kandic, Sonja Biserko, Zarko Korac, and the rest of the people whose salaries are paid for by the 'National Endowment for Democracy' (which is another name for NATO)? I spent about 2 and a half years living in Belgrade and and maybe 5% of the people I met give two hoots about Kosovo.

This is a terrible charade. Only a very small minority (mostly unemployed or pensioned people).

Also, as we can see here, Serbs in the diaspora are vocal about this issue, but they should mostly be ignored.

your constitution is unconstitutional and racist as it was submited for approval to only part of the citizens you claim to be yours:

kosova was declaired to be serbian but the approval of the constitution stating that was submited to serbia proper and it wasn't submitted also to kosova while always stating 'kosova is serbian'.

moreover, your constitution was brought unilateraly in the middle of the UN sponsored negotiations about the futur STATUS of Kosova- making your consitituion not only unconstitutional and racist but also politicaly criminal.

I would time this referendum right after Serbia gets candidate status in the EU in October(or was it November?). But the form of that question, "EU or Kosovo", is misleading, it wrongly assumes the Serbian government has actual power over Kosovo and it is asked to give it away for entry in the EU. For the referendum, the right question must be found first, one that reflects reality, for instance "EU or not EU?". I am confident that after showing great creativity in the question posed to the ICJ, the Serbian government will be able to find this other question.

People are tired of the government telling them how they will keep kosovo in Serbia wich is the same as if anyone has the power to turn back time. Kostunica is deliberately being pedantic on this point. In very few countries are referenda wholly binding on parliaments. Instead, they are meant to provide an indication of the will of the people that then guides parliamentarians as they draft the necessary legislation or constitutional amendments needed to put the end result into effect. For instance, a referendum on Quebec's independence would not mean immediate independence. It would simply provide a basis for formal negotiations and the necessary act putting the new state of affairs into being. In the case of Kosovo, a referendum cannot allow any politician to give up Kosovo the next day. It does, however, provide the basis for a constitutional amendment that would then allow the government to recognise Kosovo, or assign it the necessary authority to enter into negotiation on the terms of recognition, without violating the constitution - as would be the case at the moment.

Kostunica knows all this full well, but is choosing to adopt a legalistic line that sounds disturbingly undemocratic. Why can't the Serbian people be consulted on such an important issue? Is he so afraid what they might say?

Why anyone continues to support this man, or his party, defies belief.
