I am bit familiar with the judiciary system of Italy but more or less all democratic countries work in same way. Let me educate you.

1. To start an investigation one needs at least some proof/s that a crime has happened. (this job is done by investigators he decides if the crime is serious to be investigated or not);
2. These proof/s are then brought to “Procura” which establishes if the facts are strong enough to start an official investigation; if YES we go to point 3; if NO there is no case;
3. If the “Procura” believes that the proofs are strong enough they start with an official investigation;
4. After collecting further evidence “Procura” sends these proofs to the “giudice di indagini preliminary (GIP)” whos job is to assess if the proofs that “Procura” has brought are sufficiently strong enough to face a trial or not; If GIP is not convinced case closed or gives to “Procura” more time to do a better job; if GIP finds the evidences strong enough then he decides to send the case to
5. The trial (first grade); If the citizen is found not guilty the citizen is free- If he is found guilty he has a right to appeal the verdict to;
6. Giudice di Appello (second grade); if the citizen is found not guilty he is free - if the citizen is found guilty he has the right to appeal the verdict to;
7. Cssazione (third grade) ; if the offender is again found guilty he cannot appeal anymore.

Dick Marty is in point 1.

EULEX is asking from Marty to provide them with the evidences that he claims to have – EULEX is in point 2.

Now as you see there are at least 7 stages for one to be found guilty. It is not that democracies like to spend money and finance an expensive judiciary but they do that for one and only one reason: to reduce the likelihood that an innocent man is sent in jail and that all rights of a fair trial are guaranteed.
