Hague to decide on Šešelj request in May

Today's Tribunal's ruling in respect of show cause notice by V.Seselj and his legal team was more then just a ruling by the composition of Judges, presiding Judge has gone outside usual form seen to date when explaining the verdict in Seselj's application for dismissal off all charges due to insufficient evidence produced by the prosecution.

Mere fact that presiding Judge openly explained his position and more particularly his non agreement to most points that the other two judges had to say, whilst i am of legal opinion that prosecution has in no way produced credible evidence during the whole process, on the other hand it was evident that judge Latancie was pre-programed against Seselj from the start hence her judgment reflected that , judge Harcroft is a true gentlemen, not saying much but still young enough to be rewarded and promoted by his masters after completion of his services in tribunal.

We all know that in process of any kind the least expected is that it must seem to be fair and just, considering the words of judge Antoneti one could hardly come to conclusion that process and fairness of the other two judges are to say the least questionable. Should this trial have taken place in UK or US no contaminated evidence could be brought before the court, no corrupt witnesses could take a stand, and no prosecution team could get away with coaching and bribing witnesses to lie on the stand.
Due to the fact that judges Latancie and Harcroft have allowed this puts their credebility in question, would judge Harcroft allow such evidence in British court, no he would not, question of legal value is why not?
Judge Latancie is very inteligent and capable judge, there is no question that she can be promoted to anything higher that where she is now (due to her age) so unlike judge Harcroft she could not fall in the same category.
Judge Antoneli has proved to the legal community around the globe that he was not some lackie put in place to serve and obey with no respect to the law it self, his material will be read for generations at Harvard, Oxford, Cambridge and other quality institutions, whilst on the other hand if i was either judge Latancie or Harcroft i would consider very carefully my position and what legal legacy i would leave behind me, and what my children and grandchildren would inherit from my professional legal conduct.
I am in no way defending Seselj i would have the same stand for any other defendant considering the case and material that prosecution has produced, so considering cause of trial to date and most importantly today ruling with public written exclusions by the presiding judge there is no doubt in my mind that continuance of the trial will in no way not be adversely affected by the outcome. Judges Latancie and Harcroft have in no way proved their ability to absorb amount of material produced at the trial or alternatively they have acted on instructions from someone higher up.
Legal process in UK and US does not recognize political influence in any way,so generations to come will see and recognize which of the above mentioned categories these two judges fall in, if i was in their position and their age i would invest in my integrity and my legacy and not in tribunal which is being closed in 2 years.

Then again this is me, during the continuance of the trial we shall see

Maybe the ICTY will set him free. They've been giving surprising decisions of late, no doubt afraid of how history will judge them.

Curiously, they went after Seselj by stretching the bounds of recognizable law (or just creating new ones) yet Tomislav Mercep was left alone despite 'several' investigations. Oh, and let us remember that the ICTY announced after Izetbegovic's death that he had been under 'secret' investigation. Favorites indeed.

But aren't you one of the "We must have an independent investigation by the UN" banner wavers? Which is it the UN is able to set up a credible system or not? The ICTY is set up by the UN, any system set up by the UN to investigate "organ harvesting" allegations would be comprised of either the same or similar people.
You remind me of a child who throws a tantrum for a toy and when the parents break down and give it to him he throws it on the ground and wants a different one.
In other words you (and others) would only be happy if the UN announced it was true without investigation and ordered the punishment of "all" Albanians.

If you want proof that Serbs are treated unfairly by the hypocrits in the West then here you have it. They are keeping him in jail because he is not a western puppet.

It would be interesting to figure out how much time his trial has been delayed due to his defense manuevers and "illnesses". If they ignored his requests and proceeded with a swift trial you would just be on your soap box saying he was never given enough time to defend himself, true??

I get fed up with the sort of sick nationalism that supports this man. It degrades other Serbs and degrades Serbia to continue with the terrible attitudes of the 1990s. This man's time should be past - whether or not he is found guilty of anything - because his form of politics is disgusting and deserves no place in the world.

As for the court being a kangaroo court - so what if it is? I hope it kicks him hard.

Guilt or innocence of this man of the specific charges he's been charged with notwithstanding, how can anyone lionize this cretin?

He's on public record of saying he'd gouge out croat's eyes with a rusty spoon. He's on public record of standing up at a town hall meeting in Hrktovci and reading out names of people that have to leave or die.

He's not guilty because these aren't matters for the ICTY. They can't prove that he had command responsibility for various war crimes.

But that he's an abominable beast of a cretinous excuse for a human being is a matter of public record.

How can anyone who has any shred of human decency lionize this man, just because he stuck his tongue out an an institution you dislike?

The shame is: You can easily convict a person who killed some people with a gun. To convict a person who ordered/planned/inspired other people to kill some hundrets seems to be hard. Probably, nowadays, the ICTY wouldn't even convict Adolf H, because he didn't kill anyone in person.

Hate speech is a war crime, is it? Then we can immediately arrest bill clinton, many american politicians, tony blair and many british politicians and send them all to the hague for war crime trials. Throw in george bush jr and several of his cabinet as well.

They will never release Seslej just like the american court system will never parole Sirhan Sirhan for shooting robert kennedy in the back of the head while standing in front of him. Seselj is guilty of ignorance for turning himself in to stand trial in a kangaroo court.
