marty was not commissioned by the EU, he was commissioned by the coe with Russian sponsorship.

you are ether insulting ones intelligence pretending not to be able to distinguish between the two entirely seperate entities... or, you really are quite out of touch.

"Marty didn't unilaterally decide to investigate the issue and prepare his own personal report, and then when threatened by Thaci, invoke his immunity"

Exactly. Marty had an official task to do these investigations. So, you could compare him with a prosecutor. Imagine, you are in court, and the public prosecutor tells you 'you are suspect of having committed a bank robbery' and your reaction is 'I will sue you for this slanderous statement'. Ridiculous, isn't it? But in a way, that's how Thaci was reacting.

"If tomorrow it is discovered that Marty murdered someone 5-10 years ago, for example, his current immunity would not save him from prosecution. Limaj on the other hand is being investigated for war crimes - murder, torture, etc., which took place years before he joined parliament.
(mms, 19 March 2011 04:51)

Not exactly. In fact, both would be protected from prosecution. For example, Berlusconi in Italy is protected from proseuction. Of course, in a normal society, the parliament would decide to take away the immunity from members of parliament/government who were suspects of those severe crimes. Though, for Kosovo, I have some doubts if this would happen, even if there should be some video footage of the suspect murdering other persons.

My Lord, how ignorant some folks are. Parliamentary immunity enjoyed by Marty is an important part of a democratic system. It allows Marty to speak freely without fear of persecution while acting in his offical capacity. He was commissioned by the EU to investigate the allegations of organ harvesting, etc., and to prepare a report. Marty's immunity was in place before he began his investigation in his official capacity. Marty didn't unilaterally decide to investigate the issue and prepare his own personal report, and then when threatened by Thaci, invoke his immunity. Thaci of course knew that all along, and made threats nonetheless, to try to discredit Marty in front of his own KAlbs by attacking him personally, and raising the immunity issue, to make it appear Marty was hiding behind it. Arguments for simple minds. It was for internal KAlb consumption. If tomorrow it is discovered that Marty murdered someone 5-10 years ago, for example, his current immunity would not save him from prosecution. Limaj on the other hand is being investigated for war crimes - murder, torture, etc., which took place years before he joined parliament. He "waived" his immunity, because he knew at the end of the day it could not protect him from prosecution for war crimes. In other words, he gave away something he did not have, that is immunity from war crimes. Again, this is for internal KAlb consumption.

"So then why did he evoke his parliamentarian immunity when Thaci threatened to take him to court?"
(miri, 18 March 2011 15:39)

You used the right word. Threatening. The only thing that Thaci can do. Threatening Marty, threatending witnesses, threatening EULEX prosecutors. Surely a sign of having something to hide.

A nice PM you have elected again, dear Kosovarians...

Miri,

So Obama has to invoke his immunity when any third world nutcase makes charges against him? No, he doesn't. Marty also didn't invoke his immunity against war crimes so you are comparing oranges and apples. Marty didn't even invoke his immunity. Thaci made the charges knowing he couldn't do anything to Marty because of parlimentary immunity that is automatically conferred on Marty's speech. Thaci just wanted to make a show for the press by saying he was going to bring charges which he had to know he couldn't do unless he is a total idiot. Hold on, let me think about that one. Limaj made the same show here. It was all for public show.

Marty does not need to 'hide' because he's not an alleged criminal. Totally idiotic and invalid comparison.

What does this have to do with my comment Agim?

I don't normally comment on individual crimes but until "Kosova" gets a working witness protection system in place these "immunity" gestures mean nothing. Tell me why "Kosova" is the only place in the region where witness protection doesn't exist.

In the end it will be more than autonomy, less than independence.

Albanians are the only ones that never hidd from anybody, and if any was indicted, they turned themselv in without any problem. Serbs is a different story. We got an army "General" hidding so many years. No guts no glory.

Limaj himself asked to revoke his immunity, becasue he doews not like to hide behind that like Dick Marty.
Limaj will prevail once again, just like he did in Hague.

"...and that he is prepared to face justice whenever necessary."

Somehow impressive. A good reaction. Letting the judges and prosecutors do their job, without announcing to publish up a "helpers list" to intimidate witnesses or invent stories about an "anti-independence network", EULEX being bought by Russians or similar nonsense like some other Kosovo politician ;-)
