@kate

no kate...you can re-imagine reality all you wish.

The court DID NOT as you say "just squarely put the issue back into the political arena."

the "political arena" is where serbia is running back to in the propaganda it feeds its people.

serbs post a thousand and one "interpretations" to run from the horror of it all...but serbia will NEVER act on and challenge it legally. Interpretations are meant for your consumption.

You can Blame the "west" all you wish, but Serbia REFUSED to put forth a legal challenge. And despite all the "interpretation" you can come up...it continues to refuse to act on them.

why is that? No opinion on the matter kate? I see. Kosovo's Independence was LEGAL.

It IS Serbia that is running from the matter.

enjoy.

Exactly! Read what you have pasted and it says exactly the same as I did. Also read the independent legal interpretations all over the internet.

The "declaration" was not illegal, which is totally different from saying that the annexation of territory was not illegal. The court just squarely put the issue back into the political arena.

(kate, 27 September 2010 14:21)

Kate, the Court said clearly that the “declaration of independence did not violate Security Council resolution 1244”. Not sure what part you want to interpret. All the rest is speculation. We are not saying anything more or less; we are just saying (and we satisfied with that) that the declaration of independence did not violate Security Council resolution 1244. Are we saying anything wrong ? If so where is our error ?

We are not saying anything about annexations as we are not aware of any annexation in relation to Kosovo. To “annex” means (at least in English) to incorporate (territory) into an existing political unit such as a country, state, county, or city. With Kosovo the opposite happened; it was "de-annexed" from Serbia.

As for your accusations of 'propaganda' - you can do better than that, I'm sure. Just because I don't share your view does not mean that I am guilty of propaganda.

In fact those who just blindly follow the line on the spin fed to us by the majority of mainstream press in the 'West' are far more guilty of feeding propanganda.

"So Kosovo should be represented as an independent republic in these technical negotiations which are to take place, as Kosovo's declaration of independence was in line with UNSCR 1244 according to the ICJ."
(Ian, UK, 26 September 2010 18:49)

Strange conclusion. ICJ didn't say anything about an "independent republic". To be exact, the ICJ ruled that the UDI was not AGAINST UNSCR1244 - simply because different persons declared it, and not the ones which are mentionened in UN1244. But: What else does the ICJ ruling mean? Simple: UN1244 is still in force, though some Albanians think that the new resolution or the ICJ ruling annulled it.

Ian UK: "The ICJ ruled that Kosovo's declaration of independence was in line with UNSCR 1244 and did not violate it."

No, they did not. They ruled that making the declaration itself was not illegal. The ruling did not go beyond that or even touch upon whether the actual independence was illegal.

Ian/UK,

Hiding behind an alias or ashamed of true identity? Your Albanian dreams are enshrined in 1244. If you truly were a UK oriented individual, than poke your noggin a little further in your own backyard - you have loads of real problems there to worry about, far greater than the failing economy and last weekends papal visit.

Interesting. I thought Russians were for a solution acceptable to both. Now they seem to say anything Serbia wants we support. I wish we Albanians had friends like that.

Resolution 1244 is definitely the best basis and starting point for the negotiations between Belgrade and Pristina. I doubt that the EU/US will be able to intimidate a principled Russia the way it did Tadic - although he really had no choice, and was accommodating towards the West as to not create friction - afterall, Serbia does want EU candidacy. We all know how DC and Brussels can make life hard for small nations they can push around. Russia, as always, has been Serbia's friend and ace in the hole. So let's get to that negotiating table and start finding some real solutions for the conflicts in KiM, that are acceptable to all sides, not solutions that are forced by countries with big military and economic guns - that is, if the Albanians can find time to sit down with all the telecommunications work they are doing lately.

Ian, UK

The ICJ ruled that Kosovo's declaration of independence was in line with UNSCR 1244 and did not violate it; therefore the problem is not Kosovo's independence, but Serbia acceptance of Kosovo's independence. So Kosovo should be represented as an independent republic in these technical negotiations which are to take place, as Kosovo's declaration of independence was in line with UNSCR 1244 according to the ICJ.
