EU draft Kosovo resolution ready

EU foreign policy chief Catherine Ashton has distributed a proposed resolution on Kosovo to the EU members.

Serbia should have asked ICJ to rule whether Kosovo with its declaration of independence is a sovereign
state with controls of its borders and all others legal elements in place, required for functioning new state.This questions should be answered either by ICJ or UNSC so the real and meaningful negotiations could start between Serbia and Kosovo.It's not possible to negotiate anything with Kosovo Albanians because they already act as a independent sovereign state,which they are not there yet.As of now Kosovo international borders are in Serbians hands by UNSC Resolution 1244 and Serbs should make sure no weapons of any kind are imported in that self proclaim "independent state"ICJ decision "No violation of International law by proclaiming independence" is a very poor one it creates more potential problems World wide for minorities.Its a possible "suicide" to proclaim independence without sovereignty.In my opinion,ICJ should have addressed both Independence and sovereignty at the same time.
In any case Kosovo Albanians are no ready for any kind of state.They are still in terrorist mode attacking Serbian Orthodox Churches and Monasteries and its people.Any minority seeking independence should reach the level of maturity needed for self governance.

The usual solution is a "minimal consensus", or the "least common denominator" principle.

In this case, it probably means calling Belgrade and Pristina for talks on "subjects of common intererest in the shade of the recent ICJ rulings" - i.e. leaving room for all interpretations, and avoiding any status definitions

Serbia was certainly interested on asking whether Kosovo had a right to seccede, and I'd say that it would have had more than 60% chance of winning.

However, a resolution asking that question would not have been approved by the General Assembly.

The states that have problems with minorities would not have accepted to take the risk of asking that question to the Court ? What if Serbia lost (even though the chance was small)... All of them would have lost with Serbia, as well.

On the other hand, asking a question about the legality of the Kosovo UDIs was pretty narrow and specific. If Serbia won, good for everybody. If Serbia lost (as it did) too bad for Serbia; however it would not have an impact of the minorities of other states since the decision was about Kosovo's UDI only.

The court did not take a stand on the right to self-determination and secession.

Serbia wasn't interested on on the right to self-determination and secession otherwise it would have asked that question.

Serbia criticizes this eu draft resolution because cathy did not consult Serbia when she wrote it. This will damage Serbia's desire for euro-atlantic integration.
