Serbian prosecution indicts Kovačević

The First Municipal Public Prosecution in Belgrade indicted Miladin Kovačević for <a href="http://www.b92.net/eng/news/politics-article.php?mm=10&dd=28&yyyy=2008" class="text-link" target= "_blank">inflicting severe injuries</a> to Bryan Steinhauer in May of 2008.

This is a bit confusing because as we know he had some kind of "repatriation document" or "emergency passport" issued by the consulate. The emergency passport - if issued by the consulate - is always a valid document.

Now either he was a complete idiot and produced a fake passport at the airport while having a correct emergency document with him (this would be a deed worth a Nobel prize in theoretic Physics) - or the prosecution decided to regard the repatriation document/emergency passport as a forgery because it was obtained based on untrue statement.

If that's the case, than they are maybe indeed incorrect charging with the forgery. They should maybe charge him with lie under oath instead because during the procedure of issuing the emergency document usually people are require to say under oath that they are really citizens of the given country and the police is not after them.

"Lie under oath" is fairly close to "using a forged document" - this guy is probably toasted anyway. Good for him he does not need to "feed" the pretty dirty American justice system moneywise, but he could be ultimately better off overseas with sentence reduced to next nothing with a good and expensive lawyer. In Serbia he probably lands up paying less money but suffering more in the process.

If I say "pretty dirty American justice system" I do not mean offense. What I mean, both you and me know pretty well how the traffic courts do work and how are the cops/judges/lawyers precisely where they should be the cleanest. Because the traffic court is the only place where "normal" people would face the criminal law and the "Small Claim Court" where they face the civil law. Both courts are kangaroo. I do not have extended experience with either. Once lost a $1000 claim against credit card company - the c/c company went with a blatant lie and violated the court procedure - I lost my case just because I did not object their violation. On the other hand I won two traffic cases losing only one, so we are "even" at 2:2. But what I did see was pretty yucky and I lost all my confidence in American justice system.

This charge will not stand a chance, since the serbian consulate issued him that document ,which is valid document and not a forgery.
