Curious as to where you find that in Resolution 1244.
Organizing and overseeing the development of provisional institutions for democratic and autonomous self-government pending a political settlement, including the holding of elections;

Transferring, as these institutions are established, its administrative responsibilities while overseeing and supporting the consolidation of Kosovo's local provisional institutions and other peace-building activities;

Facilitating a political process designed to determine Kosovo's future status, taking into account the Rambouillet accords (S/1999/648);

In a final stage, overseeing the transfer of authority from Kosovo's provisional institutions to institutions established under a political settlement;
The only thing I find is the CLEAR mandate to UNMIK. whether you wish to refer to the govt of Kosovo as a provisional or final stage govt is irrelevant.
I missed the part where it specifies it has to come back to Russia and China and say "Mother may I".

1244 confirms what Serbia believes - Kosovo is its territory. What 1244 wanted was a settlement based on substantial autonomy. Maybe we should consider that it is possible to have autonomy in the north and autonomy in the south and still call it autonomy.

Serbia was bombed into 1244. In the circumstances Serbia is right to take what 1244 gives to Serbia and right to take what it doesn't! The UDI is a breach of 1244 and the bombing itself was not legally justified. The current situation is held together by power and diplomacy - not by any amount of law (1244 or otherwise).

As a 'human rights' intervention the bombing has turned into an invasion and a land grab - which severely dents the legitimacy of potential future 'humanitarian interventions' elsewhere - this is an issue that will have repercussions for years to come.

The fact that Serbia is prepared to carry on going along with 1244 is a blessing that should not be so readily taken for granted. I do think that if the UDI sustains there could a time when some future Serbian government could say 1244 no longer applies and we are taking back what is ours. The only thing that would stop it would be more bombs - and in the event of some severe destabilisation even that may not be possible.

The current Serbian government is on the way to the EU and making all the right moves. However, if the EU messes with Serbia and disillusion sets in, the future could become unpredictable. In my view the EU is pressing too hard on N Kosovo as it is, and needs to show more sensitivity if it is not one day going to be reinterpreted even more strongly as being just part of the invading territorial land grab.

In the meantime, to impose ethnic Albanian government (monoethnicity has always been the Albanian aim) on Serbs in the North is questionable and impractical. It could be badly destabilising. Pristina thinks it needs NKosovo if it is to retain any credibility. However, if the EU pushes too hard on behalf of Pristina then the whole deck of cards could come tumbling down.

The reality is that Pristina will never be very credible unless it can persuade Serbia to take it seriously. In my view, treated as an autonomous institution it could have a future in relation to Serbia, whereas as a UDI it is always going to be under the coat-tails of other powers - and it won't be happy with that for long.

Bottom line however is that as long as 1244 remains unrepealed, Serbia's sovereignty over Kosovo remains intact regardless of who is "having power" in the province at the moment. This is something you cannot evade no matter how you try.

PSS - after UDI from February 2008 - government of Kosovo is illegal structure, becouse they violated 1244. In 1244 are any words about "independent Kosovo", but only about substantial autonomy. Autonomous government of Kosovo - was created under Resolution. Pseudoindependent government - is AGAINST Resolution - so is illegal.

Goni, "Criminal parallel structures" is basically a synonym for "socio-political institutions operating outside of our control". What was considered legitimate for Albanians was considered illegal by Belgrade under Slobo. Now the roles are reversed. What reflects the popular will of the Kosovo Serbs is seen as "criminal parallel structures" by Pristina. I'm sorry you can't see the analogy but I just find it simply laughable that the very people who got where they are by operating outside the system are now the ones trying to lay down the heavy hand of their "law". And when they realize no one is taking them seriously, their words get aggressive and confrontational. A bit difficult trying to get people to take you seriously when you're always rattling sabers and threatening to destroy their own institutions, no? :)

Becouse if he read 1244 - he must read Annex 2 point 6 of this Resolution (in this point - serbian forces will be permited to return to Kosovo). What does this tell you? If both sides interpret 1244, the EULEX mission etc as they please, there can not be stability or peace. Let both sides aggree to a solution. You don't have to be Einstein to realize that the current situation doesn't work.

The "logic" used goes way beyond the usual double standards and I do not know how to respond when I read so much rubbish in a relatively small article. It should be clear that any respectable country cannot deal with people like Dell. I would like to remind the West that if UNSC 1244 is up for selective interpretation then so is Dayton. So much effort is being put into two failed projects ("Kosova" and BiH) and for what? The good thing is that I know that one day (hopefully sooner than later) the West will finally see its mistake and on that day I will open a nice bottle of wine and toast to the ignorance that people refuse to see and admit and to the the feeling of peace of mind when you follow your heart.

It is encouraging that all the mess and lack of will of UNMIK to establish law and order in north Kosova in the last 10 years now will be finally corrected.

It is uncomfortable to clean the rubbish that someone else did but better that than having rubbish in our streets.

It is refreshing to hear from US ambassador once again the essence, the main purpose of the res. 1244 that was so furiously attacked by Serbia until at least 2004-05:

1244 once and for good ceased the Serbian sovereignty over Kosova.

This was the main reason why Serbia was opposing 1244 until 2004/05 and then switched in supporting it.

Because 1244 is the best that they can have in their hands and this says volumes on what a misery they indeed have.

But no one should be worried from the law and order except criminals of course.

As you do remember (???) in ALL reports of UN secretary general (including the last one of this January) the north of Kosova is systematically assessed as the only part of Kosova where there are serious problems for the freedom of movement and the only part of Kosova where the organized crime is flourishing.

This is a fact repeated in ALL reports of UN SG to the UN SC for the last almost 11 years now.

One can chose to believe that donkeys can fly but the truth is that all reports of internationals find the Serbian dominated northern Kosova as the cradle of the crime.

And this must stop- and be assured it will.

Finally I “believed” from hearing Jeremic and Tadic that 2010 will be the year of Serbia when they will impose new negotiations on Kosova’s status.

But as it looks for now it turns out that in 2010 it will vanish even that limited influence of Serbia over the northern Kosova.

Message: don’t believe Serbian politicians even when they bring gifts.

Indeed, under 1244, Kosovo wasn't part of Serbia, but Yugoslavia....it will be foolish to think this was just luckless orthographic mistake.
Croatia made it clear before the ICJ and no wonder Tadic pointed it out as a particular stab on Serbia's back.

The fact that Serbia later legally inherited many of of former Yugoslavia's assets is hardly to be applied to Kosovo and its 2,3 million people.
They can't be compared to reserve currencies or embassies and churches...

The sole purpose of that inheritance was in a way no to hinder Serbia's EU process (which was quite retarded actually) and to have Montenegrins begun from the beginning since it was them who wanted to split...

Hans, you do not have much appreciation for international law. The points about 1244 and FRY vs Serbia has been discussed here at length and no one has seriously used this argument apart from a few of the more nationalist KAs. The fact that the US used it before the ICJ was actually an insult to the Court, which had already ruled definitively on that matter. If your logic applies then Serbia cannot be held responsible for anything that happened in Bosnia as it was named specifically, and we all knew that it existed within Yugoslavia.

It's funny how the Americans are speaking about the UNSC 1244 Resolution being violated but it's ok for Kosovo to violate the resolution by declaring independence and America along with 64 countries recognised the independence of Kosovo but the UNSC 1244 resolution clearly states that Kosovo is an integral part of Serbia and under the sovereignty of the Federal Republic of Yugoslavia, currently under the Republic of Serbia. They follow parts of the resolution that suits them but the other part that doesn't suit them it's ok to violate it. Bunch of Hypocrits!

Citizens of the northern part of Kosovo overwhelmingly support the legitimate structures functioning there. They overwhelmingly reject the parallel structures attempted to be imposed by Priština. The legal system run by ethnic Albanians is corrupt to the core and the least functioning system of the temporary institutions. This is reported by the "internationals" themselves.

The frustration is building and plainly visible. We all know the UDI is illegal. Attempting to build "legitimate" structures on an illegal foundation is not going to work.

Time to follow the path to peace and prosperity and to end the frustration coming from the authors of the UDI. We are more than capable of looking after ourselves in both KiM and RS. You can keep your corrupt legal structures to yourselves.

It should be clear that any respectable country cannot deal with people like Dell. I would like to remind the West that if UNSC 1244 is up for selective interpretation then so is Dayton. So much effort is being put into two failed projects ("Kosova" and BiH) and for what? Hans, you do not have much appreciation for international law. The points about 1244 and FRY vs Serbia has been discussed here at length and no one has seriously used this argument apart from a few of the more nationalist KAs. The fact that the US used it before the ICJ was actually an insult to the Court, which had already ruled definitively on that matter. If your logic applies then Serbia cannot be held responsible for anything that happened in Bosnia as it was named specifically, and we all knew that it existed within Yugoslavia.

What does this tell you? If both sides interpret 1244, the EULEX mission etc as they please, there can not be stability or peace. Let both sides aggree to a solution. You don't have to be Einstein to realize that the current situation doesn't work.

I'm sorry you can't see the analogy but I just find it simply laughable that the very people who got where they are by operating outside the system are now the ones trying to lay down the heavy hand of their "law". 1244 confirms what Serbia believes - Kosovo is its territory. What 1244 wanted was a settlement based on substantial autonomy. Maybe we should consider that it is possible to have autonomy in the north and autonomy in the south and still call it autonomy.

Serbia was bombed into 1244. In the circumstances Serbia is right to take what 1244 gives to Serbia and right to take what it doesn't! The UDI is a breach of 1244 and the bombing itself was not legally justified. The current situation is held together by power and diplomacy - not by any amount of law (1244 or otherwise).

As a 'human rights' intervention the bombing has turned into an invasion and a land grab - which severely dents the legitimacy of potential future 'humanitarian interventions' elsewhere - this is an issue that will have repercussions for years to come.

The fact that Serbia is prepared to carry on going along with 1244 is a blessing that should not be so readily taken for granted. I do think that if the UDI sustains there could a time when some future Serbian government could say 1244 no longer applies and we are taking back what is ours. The only thing that would stop it would be more bombs - and in the event of some severe destabilisation even that may not be possible.

The current Serbian government is on the way to the EU and making all the right moves. However, if the EU messes with Serbia and disillusion sets in, the future could become unpredictable. In my view the EU is pressing too hard on N Kosovo as it is, and needs to show more sensitivity if it is not one day going to be reinterpreted even more strongly as being just part of the invading territorial land grab.

In the meantime, to impose ethnic Albanian government (monoethnicity has always been the Albanian aim) on Serbs in the North is questionable and impractical. It could be badly destabilising. Pristina thinks it needs NKosovo if it is to retain any credibility. However, if the EU pushes too hard on behalf of Pristina then the whole deck of cards could come tumbling down.

The reality is that Pristina will never be very credible unless it can persuade Serbia to take it seriously. In my view, treated as an autonomous institution it could have a future in relation to Serbia, whereas as a UDI it is always going to be under the coat-tails of other powers - and it won't be happy with that for long.

It is encouraging that all the mess and lack of will of UNMIK to establish law and order in north Kosova in the last 10 years now will be finally corrected.

It is uncomfortable to clean the rubbish that someone else did but better that than having rubbish in our streets.

It is refreshing to hear from US ambassador once again the essence, the main purpose of the res. 1244 that was so furiously attacked by Serbia until at least 2004-05:

1244 once and for good ceased the Serbian sovereignty over Kosova.

This was the main reason why Serbia was opposing 1244 until 2004/05 and then switched in supporting it.

Because 1244 is the best that they can have in their hands and this says volumes on what a misery they indeed have.

But no one should be worried from the law and order except criminals of course.

As you do remember (???) in ALL reports of UN secretary general (including the last one of this January) the north of Kosova is systematically assessed as the only part of Kosova where there are serious problems for the freedom of movement and the only part of Kosova where the organized crime is flourishing.

Citizens of the northern part of Kosovo overwhelmingly support the legitimate structures functioning there. They overwhelmingly reject the parallel structures attempted to be imposed by Priština. The legal system run by ethnic Albanians is corrupt to the core and the least functioning system of the temporary institutions. This is reported by the "internationals" themselves.

The frustration is building and plainly visible. We all know the UDI is illegal. Attempting to build "legitimate" structures on an illegal foundation is not going to work.

Time to follow the path to peace and prosperity and to end the frustration coming from the authors of the UDI. We are more than capable of looking after ourselves in both KiM and RS. You can keep your corrupt legal structures to yourselves.

It's funny how the Americans are speaking about the UNSC 1244 Resolution being violated but it's ok for Kosovo to violate the resolution by declaring independence and America along with 64 countries recognised the independence of Kosovo but the UNSC 1244 resolution clearly states that Kosovo is an integral part of Serbia and under the sovereignty of the Federal Republic of Yugoslavia, currently under the Republic of Serbia. What does this tell you? If both sides interpret 1244, the EULEX mission etc as they please, there can not be stability or peace. Let both sides aggree to a solution. You don't have to be Einstein to realize that the current situation doesn't work.

PSS - after UDI from February 2008 - government of Kosovo is illegal structure, becouse they violated 1244. In 1244 are any words about "independent Kosovo", but only about substantial autonomy. Autonomous government of Kosovo - was created under Resolution. Pseudoindependent government - is AGAINST Resolution - so is illegal.

(in the picture) If the Kosovo Albanians wanted independence all along why do they have the Albanian flag along with the other ones??? Makes Albania look more like your home land then Kosovo. The north is Serb and always will be. Maybe when you let all 250,000 Serbs back, we can negotiate on giving you autonomy. Hate it or love it, with out Serbia now EU. Have a nice day.

Goni, "Criminal parallel structures" is basically a synonym for "socio-political institutions operating outside of our control". What was considered legitimate for Albanians was considered illegal by Belgrade under Slobo. Now the roles are reversed. What reflects the popular will of the Kosovo Serbs is seen as "criminal parallel structures" by Pristina. I'm sorry you can't see the analogy but I just find it simply laughable that the very people who got where they are by operating outside the system are now the ones trying to lay down the heavy hand of their "law". And when they realize no one is taking them seriously, their words get aggressive and confrontational. A bit difficult trying to get people to take you seriously when you're always rattling sabers and threatening to destroy their own institutions, no? :)

1244 confirms what Serbia believes - Kosovo is its territory. What 1244 wanted was a settlement based on substantial autonomy. Maybe we should consider that it is possible to have autonomy in the north and autonomy in the south and still call it autonomy.

Serbia was bombed into 1244. In the circumstances Serbia is right to take what 1244 gives to Serbia and right to take what it doesn't! The UDI is a breach of 1244 and the bombing itself was not legally justified. The current situation is held together by power and diplomacy - not by any amount of law (1244 or otherwise).

As a 'human rights' intervention the bombing has turned into an invasion and a land grab - which severely dents the legitimacy of potential future 'humanitarian interventions' elsewhere - this is an issue that will have repercussions for years to come.

The fact that Serbia is prepared to carry on going along with 1244 is a blessing that should not be so readily taken for granted. I do think that if the UDI sustains there could a time when some future Serbian government could say 1244 no longer applies and we are taking back what is ours. The only thing that would stop it would be more bombs - and in the event of some severe destabilisation even that may not be possible.

The current Serbian government is on the way to the EU and making all the right moves. However, if the EU messes with Serbia and disillusion sets in, the future could become unpredictable. In my view the EU is pressing too hard on N Kosovo as it is, and needs to show more sensitivity if it is not one day going to be reinterpreted even more strongly as being just part of the invading territorial land grab.

In the meantime, to impose ethnic Albanian government (monoethnicity has always been the Albanian aim) on Serbs in the North is questionable and impractical. It could be badly destabilising. Pristina thinks it needs NKosovo if it is to retain any credibility. However, if the EU pushes too hard on behalf of Pristina then the whole deck of cards could come tumbling down.

The reality is that Pristina will never be very credible unless it can persuade Serbia to take it seriously. In my view, treated as an autonomous institution it could have a future in relation to Serbia, whereas as a UDI it is always going to be under the coat-tails of other powers - and it won't be happy with that for long.

As to the "illegal Albanian" paralell structures in Kosovo since 1981, if you remember that is when Milosevic decided to strip Kosovo of all its autonomy which created this mess today.

Bottom line however is that as long as 1244 remains unrepealed, Serbia's sovereignty over Kosovo remains intact regardless of who is "having power" in the province at the moment. This is something you cannot evade no matter how you try.

UNMIK can't transfer power to anyone unless the Security Council agrees. Good luck getting Russia and China to do that.

Curious as to where you find that in Resolution 1244.
Organizing and overseeing the development of provisional institutions for democratic and autonomous self-government pending a political settlement, including the holding of elections;

Transferring, as these institutions are established, its administrative responsibilities while overseeing and supporting the consolidation of Kosovo's local provisional institutions and other peace-building activities;

Facilitating a political process designed to determine Kosovo's future status, taking into account the Rambouillet accords (S/1999/648);

In a final stage, overseeing the transfer of authority from Kosovo's provisional institutions to institutions established under a political settlement;
The only thing I find is the CLEAR mandate to UNMIK. whether you wish to refer to the govt of Kosovo as a provisional or final stage govt is irrelevant.
I missed the part where it specifies it has to come back to Russia and China and say "Mother may I".
