Bosnia discriminates against Jews, Roma, says court

The European Court of Human Rights in Strasbourg has condemned Bosnia-Herzegovina over a controversial ban.

How would decentralization help? The Bosnians and Bosnian Croats repeatedly complain that their rights are not respected in the Serb majority entity while the Bosnian Serbs complain that their rights are not respected in the Bosnian-Croatian entity. Just as in any other country it is the central institutions that need to ban discrimination based on race, ethnicity, religion, etc. and those laws need to be enforced on the local level. Given that the current ethnic makeup of the country is a direct result of genocide and that those returning to their homes fear for their safety and employment opportunities it is even more important the the central government creates laws that protect minority rights and that those laws are enforced on the entire territory of the state.

The Dayton Peace Accords are about as discriminating a constitutional framework as you can find anywhere in the world today. It segregates Bosnian citizens into ethnic and religious groups and then on top of that it gives certain ethnic groups preferences over others on the national lever and even more so on the local level. It legitimizes ethnic cleansing and genocide and plays into the hands of those who promote distrust and hatred amongst the Bosnian people. The court should proclaim the whole constitution to be discriminatory and undemocratic. It is time for the Bosnian people to force their elected representatives to give them a constitution that is just, functional, democratic, and that meets the requirements set out by the EU. The EU and US should stop appeasing those politicians that promote discrimination and segregation and should work closely with and promote those moderate politicians that want to shape Bosnia and Herzegovina into a modern, multi-ethnic, multi-religious, and democratic European state that benefits all of its citizens and residents.
