No, you're all wrong. The judges were right to dismiss all charges against Haradinaj.

If you look up the full name of the aforementioned court in The Hague it extends to: International Tribunal for the Prosecution of Serbs Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991.

Last time I checked Haradinaj is not a Serb...

and why is there no indications? is it because it was indicated to the witnesses that if they agree to appear, you would agree to make them dissapear?

I agree with all you said. What is the point of a retrial except to come to the same verdict and say that even with a retrial he was found not guilty? That absolves the Hague and puts an end to speculation. They cannot find him guilty now any more than they could last time but they have to go through the motions and try to clean up their image.

The witnesses are not going to recall all the details any more. Time dulls our memories so cross examining the witnesses now will be much easier. Because their memories might not be as vivid as before it will be easier to punch holes in their testimony.

I really hope I am wrong.

Even if Haradinaj is retried that is still not going to convince any Serbs that this court is anything other than a political anti-Serb kangaroo court meant to weaken and blacken Serbia.
What about Naser Oric? That war criminal bragged about massacring Serb civilians and even showed footage to a Toronto Star journalist, and the Hague set him free.
I find it very interesting that Hillary is lobbying to get Serbia into the EU, Haradinaj may get a retrial, and the IMF fat cats show up in Belgrade, all right after a very succesful visit from Medvedev.
This abomination of a court which has nothing to do with truth or justice has about 14 months of life left, and I am sure the Russians told the Americans that that is it, no extension, finito! Too late to start kissing Serbia's butt now. Truth and justice will prevail!

It's called lack of a witness protection program -- witnesses are routinely intimidated or killed, which is how people like Ceku and Haradinaj can walk free.

Haradinaj is just as "innocent" as Serbia was in the ICJ trial against Bosnia. But that verdict was happily accepted in Serbia. Of course, what suits will be always accepted. For the rest, the defaiming campaign will be used. How conveniant...

Actually it is better if Haradinaj will go free without a retrial, because that will make Karadzic's job of undermining the tribunal much easier.

Anyway the ICTY will be dead by 31 December 2010. Only a UNSC decision can delay that date and a veto from any permanent member will stop any tries to change that date.

Well its all very well analysing the legal grounds for a retrial and what might impress the tribunal.

But surely the real point is that witnesses were not provided with protection in the first place and unless their has been a drastic rethink or that they have identified new witnesses, nothing will change.

Those close to Haradinaj will threaten those witnesses and the prosecution will fail again.

And you have to ask yourself about the political will as well. This isn't just about the tribunal, its about nation states and their intelligence services - they know much of what is going on.

Still we all know who Haradinaj is and what he did. The honest argument is not whether he killed (or ordered) Serbs and Albanians - we know he did, the argument (for the honest) is whether those killings were justified or constitute a war crime.

Well since this points that some of them have lived on, why cant they testify?

If there is anything Hadinaj should face, he should be forced to face it, but the burdon of proof rest with the prosecution.

I think he would gladly accapt the invitation to clear his name. Unlike some "innocent" others who are afraid of revealing themselfs.
